ROLL CALL: <br />Chairman Burk called the meeting to order at 7:36 p.m. - <br />Present: P. Engoglia, D. Spoerke, and R Burk. <br />Absent: J. Kazak and W. Piar. <br />Also Present: Law Director Gareau, Building Commissioner Conway, and Clerk of Commissions <br />Oring. <br />II. REVIEW AND CORRECTIONS OF MIlNUTES: <br />P. Engoglia moved to approve the minutes of March 24, 1994 as presented, seconded by W. <br />Spoerke, and unavunously approved. . <br />III. COMMUNICATIONS: <br />No items. <br />J. HEARINGS: <br />1. Viewpoint at North Olmsted Golf Course, <br />Request variance to eliminate requirement to have 6 foot fence enclosing golf course. Violation of <br />Section 1135.02 ofthe building codes. <br />PLEASE NOTE: Lakes that existed originally on the golf course and were not changed are not <br />required to be fenced. • <br />Building Commissioner Conway advised that a code requirement is that any body of water must <br />be surrou.nded by a 6 foot fence. The developer was made aware of this while before Planning <br />Commission. Some lakes have been added for water retention and the developer is asking for a <br />variance and is going to submit some plans for landscaping which could impede access to these <br />area in lieu of a fence. The oath was administered to Mr. Bower, Shore West Construction, and <br />Chairman Burk advised that since there are only 3 members present, it will take 3 affirmative <br />votes to approve a request. Mr. Bower proceeded with his presentation and presented site plans <br />showing the lakes. He reviewed the ordinance which he believed related specifically to swimming <br />pools, but was broadened_ to include water areas throughout the city. These lakes or ponds were <br />created in View Point, a golf home cluster development, the two larger ones at the entry serve a <br />dual purpose both as golf cou.rse water hazards and as storm water retention basins. There is <br />another pond in the middle of the Vista Home area, and the last pond is also part of the golf <br />course and is behind hole nu.mber 2 on the golf course and is adjacent to the Vista Homes. At <br />the Planning Commission the suggestion was made that landscaping could be used 'm lieu of <br />fencing which would provide an impediment to people entering the lake areas. He believed that <br />these lakes differ from swrimming pools in that they are golf course features with a gradual slaapa
