? - <br />CITY OF NORTH OLMSTED. <br />BOARD OF ZONING APPEALS. <br />MINUTES-AUGUST 4, 1994 <br />Chainn_an Gomersall called the meeting to order at 7:30 p.m. <br />Present: T. Koberna, J. Maloney, W. Purper, and R. Gomersall. <br />Ms. Boyle arrived later. ? <br />Also Present: Law Director Gareau, Building Commissioner Conway, and Clerk of Commissions <br />Oring. <br />Chairman Gomersall corrected the minutes of June 9th, page 1, item 2, the last line should read <br />48 inches, not 48 feet. J. Maloney moved to approve the minutes of June 9, 1994 as amended, <br />seconded by T. Koberna, and unanimously approved. <br />W. Purper moved to approve the minutes of July 6, 1994, as submitted, seconded by J. Maloney, <br />and u.nanimously approved. <br />Chairman Gomersall advised all present that each of the board members had viewed;he premises <br />involved in each case and that 3 affirmative votes. would be required for approval. 'Each case <br />would be judged on the physical situation peculiar to itself so that in no way is a judgment <br />rendered considered to be a general policy judgment affecting properties and like situations <br />elsewhere. <br />1. David T. Kokitka, 7139 Barton Road.. <br />Request for variance (1123.12). Request 130 square foot variance for area exceeding the 2% <br />maximum rear yard coverage permitted, and 3 foot, 6 inch rear ,yard variance for location of shed. <br />Violation of Ord. 90-125, Sections 1135.02(D)(1) and (D)(4). Please Note: Shed is installed and <br />previous variance for a larger building had been continued from meeting on July 7, 1994 and <br />withdrawn from meeting of August 4, 1993. <br />Chairmasi Gomersall called all interested parties before the board. The oath was administered to <br />Mr. Kokitka. Mr. Gomersall reminded him that he had requested a similar variance previously and <br />when the board indicated they would not approve that la.rge a structure, he withdrew the request <br />and never returned. Mr. Kokitka explained that this structure is about half the size as the original <br />one and is 6 feet lower. H'is wife bought it and had it installed as a gift. He questioned why a <br />height variance was required. Mr. Conway clarified that the 3 foot, 6 inches was not height, it was <br />for the encroachment on the rear lot line. Mr. Kokitka submitted photographs of the shed and <br />presented a letter from the neighbor to the north advising that he had no objection to the shed. <br />The members had no further questions. W. Purper moved to grant the request to David T. <br />Kokitka, 7139 Barton Road, for a 130 square foot variance for area exceeding the 20% maximum <br />rear yard coverage permitted, and a 3 foot, 6 inch variance from rear lot line for shed. Violation of <br />Ord. 90-125, Sections 1135.02(D)(1) and (D)(4). The motion was seconded by R. Gomersall, <br />and u.nanimously approved. 2. The Men's Wearhouse, 25931 Great Northern Shopping Center. <br />Request for variance (1123.12). Request 22.5 square foot variance for total sign area over that <br />'.?., <br />permitted for a business uuit. Also request 2 inch variance for height of sign. Violation of Ord. <br />90-125, Sections 1163.11(c) and 1163.12(a).
