s..' <br />, . <br />f rl <br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />MINIJTES-SEPTEMBER 7, 1994 <br />Chairman Gomersall called the meeting to order at 7:30 p.m. <br />Present: M. Boyle, J. Malonay, W. Purper, and R. GomersalL <br />Absent: T. Koberna <br />J. Maloney moved to accept the August 4, 1994 minutes as prepared, seconded by W. <br />Purper, -a.nd unanimously approved. <br />Chairinau Gomersall advised all present that each of the board members had viewed the <br />premises involved in each case, and that 3 affirmative votes would be required for approval. <br />Each case would be judged on the physical situation peculiar to itsel? so that in no way is a <br />judgment rendered consider to be a general policy judgment affecting properties and like <br />situations elsewhere. <br />1. Krista M. Merrill. 3580 Hunter Drive. <br />Request for variance (1123.12). Request 25 foot variance to install 6 foot wood privacy fence <br />in side yard of a corner lot which would abut the front setback of the adjacent house. <br />Violation of Ord. 90-125, Section 1135.02(f-2). Continued from meeting ofAugust 4, 1994. <br />Chairman Gomersall called all interested parties before the board. The oath was administered <br />to Mrs. Merrill who explained that they had no back yard and needed this area for their <br />children to play. No neighbors were present. Mr. Gomersall believed that a 6 foot fence would <br />stick out on the side street. Mrs. Merrill suggested that they could place the fence at an angle, <br />so that it did not extend out so far or they would even agree to a 15 foot variance so the fence <br />would be further back. The members were more concerned with the height of the fence, and <br />suggested that a 4 foot fence would not look so much like a fortress. Mrs. Merrill agreed to <br />the 4 foot fence and stated that if her husband did not agree, they just would not build it. Mr. <br />Gomersall moved to grant I{rista M. Merrill, 3580 Hunter Drive a 25 foot variance to install a <br />4 foot wood privacy fence in the side yard of a comer lot which would abut the front setback <br />of the adjacent house. Violation of Ord. 90-125, Section 1135.02(f-2)_ The motion was <br />seconded by J. Maloney, arid u.nanimously approved. Variance granted. <br />2. CenCor. 23867 Lorain Road. <br />Request for variance (1123.12). Request variance to place temporary sign on front of building <br />unit. Violation of Ord. 90-125, Section 1163.12(g). <br />Chairman Gomersall advised that this request had been withdrawn by the applicants. <br />3. Clark Oil, 28925 Lorain Road. <br />Request for variauce (1123.12). Request 119.5 square foot variance for sign area over the <br />total allowed for a business use; request 19 square foot variance to install 2 signs on pump <br />canopy; request 43 square foot variance for signs located on a 3 pump dispensers; and request <br />variance for location of pole sign which is in the 35 foot prolubited triangular area. Violations <br />ofOrd. 90-125, Sections 1163.11(a); 1163.120);1163.12(b).
