CITY OF NORTH OLMSTED <br />BOARD OF BUII.,DING CODE APPEALS <br />MINiJTES - JUNE 22, 1995 <br />1. ROLL CALL: <br />Chairman Burk called the meeting to order at 7:40 p.m. <br />Present: P. Engoglia, J. Kazak, and R. Burk <br />Absent: W. Piar and D. Spoerke <br />Also Present: Councilman D. McKay, Bu.ilding Commissioner Conway and Clerk of Commissions Oring. <br />U. REVIEW AND CORRECTIONS OF NIINiJTES: <br />J. Kazak moved to accept the minutes of April 27, 1995 as printed, seconded by P. Engoglia, and <br />unanimously approved. <br />III. COMMUNICATIONS: <br />No items. <br />N. HEARIlNGS: <br />1) Stephen & Darlene DiMaria (Energy Wise Construction, Inc.), property located between 23964 Lucille <br />and 4691 Grace Road, permanent parcel number 237-16-029. <br />Request determination pursuant to Building Code Section 1315.04(c) if any material (to be explained) as <br />a method of construction may be used even though not specifically authorized by the building code. <br />This proposal was canceled due to improper notification. The members decided that this request could be <br />rescheduled for July 13, 1995. <br />V. NEW BUSINESS: <br />No items. <br />VI. OLD BUSINESS: <br />Joint meeting with the Legislative Committee of Council: Discussion of licensing requirements and <br />information necessary to implement a program for the licensing of private home inspectors by the City of <br />North Olmsted. Continued from the canceled meeting of May 25, 1995. <br />Couucilman D. McKay, Chairman of the Legislative Coinmittee of Council explained that one of the <br />other members, Councilman Lind, was ill, but that he had expected Councilman Musial. Mr. McKay has <br />studied the minutes of the previous discussions. Mr. Burk reviewed those discussions: if home <br />inspections should be done independently or by city inspectors; if done independently, what qualifications <br />should be required; should applicants be tested or, interviewed or both; and finally, what fees should be <br />required. Mr. McKay advised that Council had discussed point of sale inspections about a year ago and <br />was opposed to the city conducting these inspections. He has not polled them recently, but assumed that <br />they were still in agreement. One reason was that they did not want the city to take the responsibility of <br />approving the sale of the home, since if sometluug went wrong, the city would be held accountable. They <br />were not opposed to the city having some control over the people who do make the inspections. There <br />had been a problem with an inspection made on a house on Mastic Road when an inspector had advised <br />the buyer that the problem with the foundation was nothing to worry about, and the new owrier,later <br />discovered that there were serious problems with the foundation. Eventually, the problem\was,worked <br />out. Mr. Kazak stated that they were not asking to have city inspectors to the inspection ; tliey were' <br />asking to register the private home inspectors. Mr. Burk noted that one member of the board was <br />opposed to this, but the others were in agreement. Mr. Conway advised that at this point the board must <br />establish some criteria for registration, and if there was a problem after an inspector was registered, there
