, <br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />MINUTES-DECEMBER 6, 1995 <br />Chainnau Gomersall called the meeting to order at 7:35 p.m. <br />Present: M. Boyle, T. Koberna, J. Maloney, W. Purper, and R. Gomersall. <br />Also Present: Law Director Gareau, Assistant Building Commissioner Rymarczyk, and <br />Clerk of Coinmissions Oring. <br />W. Purper moved to accept the minutes of November 1, 1995 as written, seconded by T. Koberna, and <br />unauiinously approved. <br />Chairman Gomersall advised that each case would be judged on the physical situation peculiar to itsel? so <br />that in no way is a judgment rendered considered to be a general policy judgment affecting properties and <br />like situations elsewhere. He explained that it would take three affinnative votes to approve a request. <br />1. O.S.V. Productions, 29587 Lorain Road, <br />Request for variance (1123.12). Request 3 foot variance for required landscape buffer on east property <br />line. Violation of Ord. 90-125, Section 1139.07. <br />Referred by Planning Commission November 28, 1995. <br />Chairman Gomersall called all interested parties before the board. The oath was administered to Mr. <br />Acciarri, architect, who presented the plans which reflect the recommendations of planning commission. <br />He explained the location of the property and the history of what had happened at planning commission. <br />They were unable to come to an agreement with the owner of the adjacent building to co-develop both <br />properties. At the direction of plauning commission they are now presenting a plan which only needs a 3 <br />foot variance for the landscape buffer on the east side of the property. The members had no problem with <br />the proposaL J. Maloney moved to grant the request of O.S.V. Productions, 29587 Lorain Road for a 3 <br />foot variance for required landscape buffer on east property line. Violation of Ord. 90-125, Section <br />1139.07. The motion was seconded by T. Koberna, and unanimously approved. Variance granted. <br />2. James and Elizabeth Wilson, 29642 Welling,ton Drive. <br />Request for variance (1123.12). Request 22 square foot variance to construct shed which exceeds 2% of <br />the rear yard area. Violation of Ord. 90-125, Section 1135.02(d-1). <br />Chauinan Gomersall called all interested parties before the board. The oath was adininistered to Mrs. <br />Wilson who explained that they wanted to replace a dilapidated shed that was on the property. Chau-man <br />Gomersall did not think the size was a problem. The Building Department had been concerned about the <br />location of the shed since it is directly behiud the attached garage, and there could be a problem if <br />flammable were stored in the shed. Mr. Gomersall suggested that she move the shed 10 feet away from <br />the garage. Mrs. Wilson agreed. R. Gomersall moved to grant to James and Elizabeth Wilson, 29642 <br />Wellington Drive, their request for a 22 square foot variance to construct a shed which exceeds 2% of <br />the rear yard area with the agreed -on stipulation that the shed be no closer than 10 feet from the <br />dwelling. Violation of Ord. 90-125, Section 1135.02(d-1). The motion was seconded by W. Purper, and <br />unanimously approved. Variauce granted. . <br />3. Westbury Apartments /Consolidated Mgt., 25151 Brookpark Road. <br />Request for variance (1123.12). Request variance to have second identification ground sign; request 9 <br />square foot variance for area of sign; and 1 foot, 10 inch variance for height of sigu. Violation of Ord. <br />90-125, Section 1163.07(d).
