<br />CITY OF NORTH OLMSTEI) <br />BOARD OF ZONING APPEALS <br />MINUTES- JUNE 5, 1997 <br />Chairman_ Gomersall called the meeting to order at 7:45 p.m <br />Present: T. Koberna, J. Maloney, P. Miller, and R. Gomersall. <br />Also present: Law Director Gareau, Assistant Building Commissioner Rymarczyk, and Assistant <br />Clerk of Commissions Cornish. <br />W. Purper moved to approve the corrected minutes of the May 1, 1997 meeting as written, <br />seconded by J. Maloney, and unanimously approved. <br />Chairman Gomersall advised that each case would be judged on the physical situation peculiar to <br />itselt so that in no way is a judgment rendered considered to be a general policy judgment affecting <br />properties and like situations elsewhere. <br />1. Bruce Wiebusch, 4627 Georgette Ave. <br />Request for variance (1123.12). <br />Request a variance to intrude 15 foot into the 25 foot side set back of the dwelling with a fence 5 <br />foot high. Violation of Ord. 90-125, Section 1135.02 (f-1). Fence would be constructed 10 foot <br />inside the public sidewalk with a return approximately 8 foot from the east end of the garage. <br />Placement of fence would not appear to interfere with a view of either street or pedestriau traffic <br />either from the intersection or from appellant's driveway. <br />Chairmau Gomersall called all interested parties before the board. The oath was administered to Mr. <br />Wiebusch and Councilman McKay. Chairmau Gomersall clarified that he would like to intrude 15 <br />feet into the side setback with a 5 foot high fence. The members had a letter from a neighbor who <br />objected to the variance. Mr. Wiebusch explained that his neighbor misunderstood the request <br />because he thought the fence would be in the front yard, not the side yard. Councilman McKay <br />stated that the neighbor had called him and explained his concerns, but after looking at the situation, <br />he did not think there would be a problem. The members had no problem with the request. <br />W. Purper moved to grant a request for Bruce Wiebusch, 4627 Georgette Avenue for a variance to <br />intrude 15 foot into the 25 foot side set back of the dwelling with a fence 5 foot high. Violation of <br />Ord. 90-125, Section 1135.02 (f-1). -Fence would be constructed 10 foot inside the public sidewalk <br />with a return approximately 8 foot from the east end of the garage. T, Muffler, 28256 Lorain Rd. . <br />Request for varia.nce (1123.12). . <br />Request variance to install ground sign in the 35 foot triangle aud less than 25 feet from the side <br />properiy line, as the sign will be only 15 feet from the property line. <br />Violation of Ord. 90-125, Section 1163.12 (B). <br />Note: The proposed total business signage use of 50.4 square feet is predicated on the fact <br />that Tuffy is requesting a variance on the new ground sign.
