, CITY OF NORTH OLMSTED BOARD OF ZONING APPEALS MINUTES - SEPTEMBER 3, 1986 Chairman Retnmel called the meeting to order at 7:40 p.m. Present: R. Bugala, R. Gomersall, B. Grace, J. Helon, and C. Remmel (Mr. Grace, a new member, was sworn in previosuly by Mayor Petrigac) Also Present: Law Director M. Gareau, Building Commissioner S. Spino, and Clerk of Commissions B. Oring R. Gomersall moved to approve the Minutes of July 2, 1986 as presented, seconded by R. Grace, and unanimously approved. Due to the resignation of Mr. Graves, Chairman Remmel announced that the election of a Vice-Chairman was necessary. C. Remmel moved to nominate R. Bugala as Vice-Chairman, seconded by J. Helon. No other nominations were made. Mr. Bugala was elected Vice-Chairman unanimously. Mr. and Mrs. Wm. Menefee, 6173 Wild Oak Dr. Request for variance (1133.13). Request 12' rear yard variance (corrected request) for patio enclosure. Violation of Ord. 62-33, Section 1163.01. (Tabled at meeting of July 2, 1986). Chairman Remmel called all interested parties before the Board. The oath was administered to Mr. Menefee and Mr. Round, contractor. Mr. Remmel ex- plained that this was continued from the last meeting because there were some questions as to the rear yard set back. The Building Department has checked and thq variance they are now requesting has been reduced to 12'. Board had no questions on the proposal. R. Bugala moved to grant the request for a 12' rear yard variance at 6173 Wild Oak Dr., seconded by R. Gomersall. Roll call on motion: Bugala, Gomersall, Grace, and Helon, No. Mr. Remmel, Yes. Motion failed to pass.; Vari•ance denied. l. William L. Wolfe, 5672 Whitehaven . Request for variance (1133.13). Request variance for above ground swimming • pool (instal'led) which is less than 10 feet from property line and from dwelling. Violation of Ord. 62-33, Section 1151.01-E. Chairman Remmel called all interested parties before the Board. The oath was administered to Mr. and Mrs. Wolfe. Chairman Remmel stated that the pool was practically on the street and that there is no fence, only chicken wire. Mrs. Wolfe advised that they had put the wire up temporarily and will install a fence later. R. Bugala moved to provide the variance for the above ground pool at 5672 Whitehaven, seconded by B. Grace. Roll call on motion: Bugala, Gomersall, Helon, and Remmel, no. Mr. Grace, yes. Motion failed to pass. Variance denied. 2. Harry G. Koenning, 26926 Butternut Ridge Rd. Request for variance (1133.13). Request 228 sq. ft. variance for garage addition. Violation of Ord. 62-33, Section 1151.04-C. Also request 6" side yard variance: Violation of Ord. 62-33, Section 1151.04-C. Also request special permit to add to non-conforming garage. Special permission required
