<br />. <br />CITY OF NORTH OLMSTED <br />PLANNING COMMISSION <br />MINUTES - SEPTIIMBER 10, 1985 <br />I. ROLL CALL: <br />Chairman Burns called the meeting to order at 8:05 p.m. <br />Present: T. Morgan, E. Traczyk, J. Brown, and J. Burns <br />Absent: B. Gorris and J. Wixted. <br />Also Present: Assistant Law Director J. Dubelko, Building Commissioner E. <br />Gundy,.City Engineer J. Schaller, Council members R. Bierman, <br />Y. Petrigac, R. Tallon, and R. Wilamosky, and Recording <br />Secretary B. Oring. <br />II. REVIEW AND CORRECTION OF MINUTES: <br />On page 3, item 5, motion should read "...units be screened and including <br />the recommendations of the Architectural Board of Review....." T. Morgan <br />moved that the Minutes of July 23, 1985 be approved with the amendment in- <br />cluded, seconded by J. Brown, and unanimously approved. <br />III. BUILDING DEPARTMENT REQUESTS: <br />2) Hennie Homes, located west of 25200 Lorain Rd. <br />Proposal to construct retail building <br />(Heard by Architectural Board of Review on August 21, 1985). <br />Heard out of order at this point. <br />As requested previously Assistant Law.Director Dubelko reported that <br />the Law Department has determined that once the center line of a pro- <br />posed street has been recorded, it is a street for the purposes of the <br />Zoning Codes and that all applicable provisions of the code do apply. <br />This property would then be considered a corner lot. Building Com- <br />missioner Gundy stated that he had evaluated the proposal on the basis <br />of a corner lot, and that the building will face both streets. Corner <br />lots require one 50' set back and one 25' set back, the code does not <br />make any street the predominate street. The Reverant) Blasius, pastor <br />of the adjacent John Knox Church and a member of their board had con- <br />concerns about traffic congestion in the area. They had previously <br />submitted a letter objecting to the development and in it quoted a, <br />letter from former Mayor Ralph Christman advising them of the 50' set <br />back requirement. They also noted that.their plans were subsequently <br />revised to conform with this provision and questioned why this devel- <br />opment was not required to conform to it as well. Assistant Law Dir- <br />ector Dubelko stated that the former mayor's letter would not have any <br />precedential value. Safety Department report from Captain Krynak, N. <br />O.P.D., stated that it is his belief that the drive as located would <br />cause a great deal of congestion and accidents. The reasons being, <br />persons attempting to turn left into the drive who were going east, <br />would be head on into the left turn movement onto Great Northern, <br />which is always heavy. Persons exiting would not be able to do so
