Horvath, E. Graves, T. Restifo, and C. Remmel <br />Absent: R. Bugala ? <br />rJ . <br />A1so Present: Law Director M. Gareau, and Building Commissioner E. Gundy-----__„ <br />L. Horvath moved to approve the minutes of August 3, 1983 as submitted, <br />seconded by C. Remmel and unanimously approved. <br />Chairman Remmel reviewed the Board procedures for those in attendance. <br />l. Marcus Borngen, Jr., 5984 McKenzie Rd. <br />Request special permit to add to non-conforming dwelling (front set back). <br />Special permission required Ord. 62-33, Section 1231.02. <br />Chairman Remmel invited all interested to stand before the Board and the <br />oath was given. It was established that the porch would be screened only. <br />L. Horvath moved to grant the special permit as requested, seconded by <br />E. Graves, and unanimously approved. Special permit granted. <br />2. K. & S. Grabo, 25768 Timber Cove Lane' • g <br />Request for variance (1133.13). Request 20 sq.ft. variance and 2' height <br />?variance for shed. Violation of Ord. 62-33, Section 1151.04D. <br />Chairman Remmel invited a11 int.erested to stand before the Board and the <br />oath was given. Before the Board were Kurt and Susan Grabo, property owners <br />and neighbor Mr. Goebel. Variance request was due to the pre-built type <br />of construction. The building will be used for outdoor equipment storage. <br />The location is the left rear corner of the property. Mr. Goebel's property <br />is on the opposite side of the location. Chairman Remmel moved to grant the <br />variance, seconded by Graves. Roll call on the motion: Horvath no. Graves <br />no, Restifo no, Remmel no, request denied. • <br />3. Rini's Supermarkets, Inc., 26035 Lorain Rd. <br />Request for ruling (1133.11). Request that the Board of Zoning Appeals rule <br />whether the Rini property falls under the category of "Through Lot" and, if <br />not, to determine what lot category this property falls under. "Through <br />Lot" defined under Ord. 62-33, Section 1125.49. (Variance denied August 3,1983). <br />r' <br />Chairman Remmel invited all interested to stand before the Board and the <br />oath was given. Before the Board were Charles Rini, Architect George Draeger, <br />and Richard Carlyle, from Biskind Development. Mr. Restifo noted that the <br />Putt Putt Miniature Go1f Course was made obscure by the development of <br />Chi Chi's and Pick and Pay. Mr, Remmelrequested Law Director Michael Gareau <br />to furnish a legal opinion regarding the definintion of a"Through Lot". - <br />Law Directox Gareau noted that Brookpark Road is "limited access", and he <br />considers existing deVelopment to be "rear yard type". Special assess- <br />' ments would not be charged on this frontage to abutting property owners.
