CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />JULY 11, 1979 - MINUTES <br />Chairman Ledvina called the meeting to order at 7:30 p.m. <br />Present: Chairman Ledvina, C. Remmel,'E. DeVoto, and L. Horvath <br />Also Present: <br />Law Director M. Gareau, Building Commissioner E. Gundy, <br />Councilwoman Y. Petrigac an d Re cording Secretary B. Orin g. <br />Review and Corre ction of Min utes: In the Minutes of June 13, 1979, <br />Case Number 13 should read "Mr. Remmel made a motion to grant the 92 <br />square foot variance, seconded by Mr. Horvath. Roll call on motion: Messrs. <br />Remmel, Horvath and DeVoto, yea; Messrs. Ledvina and Fairfield, nay. ,, <br />Also, on Page q ,? third last sentence, date of Mr. Fairfield's resignation <br />should be June 14, 1979. L. Horvath moved to approve the Minutes of <br />June 13, 1979 as corrected, seconded by E. DeVoto, and Lmanimously approved. <br />Cases. Continued from June 13, 1979: <br />Carl D. Bower, s/1 102 Burns Rd. (Northeast corner of Burns and the <br />undeveloped Northern Ave. ) Request for variances (1133. 13) : 1) Request <br />14' corner lot variance (requires 25° set back) violation of Ord, 62-33, <br />Section 1159.02, 2) Request 2' sideyard variance, violation of Ord. 62-33, <br />Section 1161.02, 3) Request 20' corner lot variance for garage, violation of <br />Ord. 62-33, Section 1159002, 4) Request for 51 Sqa Ft. variance,: violation <br />of Ord. 62-33, Section 1153.01. Approval to build on 'a 40' lot granted <br />by the Board of Building Standards contingent on approval by Board of <br />Zoning Appeals of variances. <br />Carl D. Bower s/l. 172 Porter Rd. Southeast corner of Porter and the <br />undeveloped Northern Ave. Request for variance (1133.13): 1) Request <br />14' corner lot variance (requires 25° set b ack) violation of Ord. 62-33, <br />Section.1159.02, 2) Request 2° side yard variance, violation of Ord.62-33, <br />Section 1161.01, 3) Request 20' corner lot variance for garage, violation <br />of Ord. 62-33, section 1159.02, 4) Request 51' Sq. Ft. variance, violation <br />of Ord. 62- 33, Se ction 1153.01, Approval to b uild on a 40° lot granted by <br />Board of Building Standards contingent on app roval by Board of Zoning <br />Appeals of variances. <br />Both of these cases were continued in order to determine how the City <br />would feel about vacating Northern Aveo If the City were in favor of this <br />Mr. Bower would be given half of Northern Ave. and his lots would both be <br />burldable without variances. Law Director Gareau advised that the matter <br />was discussed at the BZD Committee of Cotmcil and that it was received <br />favorably. It is now up to the adjacent property owners to submit a <br />petition reques ting the vacation of Northern Ave. Since this proceedure <br />would be time consuming, Mr. Bower decided that he would still request the
