10 <br />? <br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />is MAY 2, 1979 - MINUTES <br />Chairman Ledvina called the meeting to order at 7:30 p.mo <br />Present: Chairman Ledvina, C. Remmel, J. Fairfield, L. Horvath <br />Absent: E. DeVoto <br />Also Present: Building Commissioner E. Gundy, Law Director M. Gareau, <br />and Recording Secretary B. Oring. <br />Review and Correction of Minutes: C. Remmel moved to approve. the minutes <br />of April 4, 1979, as written, seconded by L. Horvath, and unanimously <br />app rove d. <br />Chairman Ledvina advised that Case #6 was to be called first. <br />6. Gerald A. Danzey, 4456 Lansing Dr. Request for variance (1133.13). <br />Request for 19' '8" set back variance, violation of Ord. 62-33, Section <br />1159.01, and request for variance (1133.13). Request for 1' side yard <br />variance, violation of Ord. 62-33, section 1161.01 to build attached <br />garage. Chairman Ledvina requested that all interested persons appear before the <br />Board. The oath was administered. Mr. Remmel observed that none of the <br />neighboring houses projected that far out into the front set back area, and <br />that there was room in the b ack of the property to build the garage. Mr. <br />Danzey explained that putting the garage at the rear of the property would <br />prove a financial burden since it would require a 150` to 200' driveway and <br />would necessitate-"taking out approximately 6 trees that are approximately <br />20" in circumferanceo C. Remmel made a motion to reject the request, sec- <br />onded by D. Ledvina. Roll call on motion: Messrs•. Remmel and Ledvina, aye. <br />Messrs. Horvath and Fairfield, nay. Three yes votes are required to pass <br />a motion. Law Director M. Gareau advised that if the Board fails to get the <br />three votes to approve a motion the case would be continued. After a brief <br />discussion as to whether the plans could be altered so that a smaller var- <br />iance would be required, Mr. Fairfield made a motion to continue the case, <br />seconded by Mr. Horvath. Roll call on motion: Fairfield, Horvath, and <br />Ledvina, Aye. Mr. Remmel, Nay. Motion passed, case continued. <br />1. James C. Powell, 23910 Gessner. Request for special permit to add to <br />a non-confo rming dwelling. Violation of Ord. 62-33, Section 1231.02. <br />Chairman Ledvina asked all interested parties to step before the Board. <br />The oath was administered. After a very brief discussion Mr. Remmel moved <br />to grant the special request, seconded by Mr. Horvath, and unanimously <br />approved. Special perniit granted. <br />2, Margaret J. Baker, 4776 Porter Rd. Request veriance for 6' fence. <br />? Violation of Ord. 62-33, Section 1151.04 (H).
