L, <br />GITY OF NORTH OI,PZSTED <br />DECEMBER 6. 1978 <br />BOARD OF ZONING APPEALS -MINUTES <br />Chairman Ledvina called the meeting to order at 7:30 p.m. <br />PRESENT: Chairman Ledvina, Mr. Remmel9 Mr. Fairfield and Mr. DeVoto <br />ALSO PRESENT: Building Commissioner Gundy, Law Director A1r. Gareau <br />and Recording Secretary Oring. <br />Mr, I'airfield moved to accept the minutes of November 1, 1978 as read, <br />seconded by Mr. Remmel and approved unanimously. <br />Continuance of hearing of Fisher Fazio's, 4700 Great Northern Blvd. <br />Request for variance (1133.13). Request is to build a new dock, <br />parallel to building. Violation of Ord. 62-33, Section 1214.02. <br />(setback of loading doclc from single residential zoning.) <br />Chairman Ledvina called the applicant and all interested persons <br />before the Board. The oath was given. It was explained that this <br />case was continued Uecause proper notice was not given to some of <br />the adjacent properties. The request was explained. Residents had <br />complaints regarding trash and noise that were referred to the Police <br />Department, but over which the board had no authority. The location <br />was explained. Discussion ensued. Mr. Remmel observed that a <br />solid wall or fence might improve the conditions. Councilmen <br />Beatty and Wilamosky were sworn ino P4r. Remmel moved that the <br />variance be granted with the condition that a solid type of <br />barrier 6' high be constructed, 150' in length measured from the <br />center of the new dock 75 feet in either direction. Seconded by <br />Mr. DeVoto. Roll call on motion: Mr. Remmel aye, Mr. DeVoto aye, <br />Mr. Ledvina aye, and Mr. Fairfield nayo Motion passed. <br />Rehearing of Milt Gates, 5813 McKenzie Road. Request for variance <br />(1133.13). Request to reduce size of front yard at permanent <br />parcel number 235-14-76 by 10 feet. Violation of Ord. 62-33 Section <br />1159.01, Also, request for 4 foot sideyard variance. Violation of <br />Ord. 62-33 Section 1161.01. <br />Mr. Ledvina called all interested persons to assemble before the <br />board. The oath was administered.• Mr. Ledvina explained that <br />the case was being reheard because of improper identification of <br />property. The board approved the first variance July 12, 1978 <br />but the lot was not identified correctly at that time. Mr. Gates <br />stated that he was agreeable to moving the house b ack to conform <br />with other houses that mi.ght be built. Discussion continued re- <br />garding side line variance. Mr. Fairfield moved to grant the 4 ft. <br />combined side line variance with the condition that the home will be <br />built at a 50 ft. set back line. Seconded by Pir. Devoto. Motion <br />passed unanimously. <br />
