PRESENT: Chairman Ledvina, Mr. Remmel, Mr. Horvath, Mro Fairfield apd Mr.'DeVoto ALSO PRESENT: Building Commissioner Gundy, Law Director Gareau and Recording <br />Secretary Spencer <br />Mr. Remmel moved to accept the minutes of August 2, 1978 as presented. Mr. Horvath <br />seconded and motion passed. 1. William J. Coming, 6584 Louann Drive. Request for variance (1133.13). Request <br />for 20" side yard variance for fireplace. Request for combined total of 13' 4" <br />(15@ total required.) Violation of ord. 62-33 section 1161.01o <br />Chairman Ledvina requested the applicant and all other interested persons to <br />assemble before the Board. The oath was administered. Mr. Remmel moved to <br />accept the applicant's request and grant this variance. Mr. Horvath seconded <br />and motion passed unanimously. . <br />2. Mre and Mrs. Arthur Bibbs, 23472 Westchester. Request for variance (1133.13). <br />Request to exceed 4' height of existing hedge which is located on front and <br />side yards of corner lot. Violation of ord. 62-33 section-1151.04 (H)2. <br />Chaii-nan Ledvina requested the applicant and all other interested persons to <br />assemble before the Board. The oath was.oiven. Ms. Lesley Brumbach, Attorney <br />at Law, representing Mr, and Mrs. Bibbs,. came before the Board. Mr. Ledvina <br />observed that this is an unusual case in that the house in question is bordered <br />on 3 sides with a street:- Mr. Ledvina wished to:-clarify what exactly was con- _ <br />sidered the-sideyard in this case. It was determined that the sideyard is along <br />Olmsted Drive. Ms.- Briunbach_distributed photographs of the site in question. <br />She pointed -out that the .backyard-of_.M-r: and Mrs.- Bibbs_ -is - on a public- street <br />and -they-would-like- to_ have=_a-_6' hedge-for _ps3vacy.- :She--also=pointed _out-that_:._-_=- <br />if the hedge would_be_ cut=_down to_ 30"=.along the :sideyard=tfiis still- would_afford _ <br />sufficient space to see either a car coming or children=-on bikes,-etc.--Mr.- _ <br />Fairfield._moved to grant-a va-riance--for a 6'- hedge condi-ti-oned-on__the .abso_lute__: _.- <br />maintenance--of the.set-back area at. 30" maximum and,.upon-any=citation.by fhe--- <br />Building Depar-tment, this variance_-would be_ revoked.--_The-30". -area is -to be_":-;__ <br />maintained--to -the set-back area of the house. The oath was given. -Mr. Ledvina.observed that this is a very deep <br />lot behind this parcel (300 plus feet.).
