Greene, TTelson' Forcellini, Roberts <br />Also present: Mr. Gundy, Building Commissioner <br />The minutes of the 8/21/68 meeting were approv'ed as written. <br />1. -kppellant: Snider Building Company. Continua-tion of request for variunce to <br />erect a house at 6729 Chadbourne Driv'e -with insufficient rear yard. <br />Reauest is in,violation of Ordina.nce ;?62-33, Section 1163.0I which <br />requires a 501 rear yarcl. <br />FresPnta Mrs Bennett., Mr, B3skind, Mr. Yanke <br />.A letter frors PZr. Bennett was reG.d in which he restated the efforts that bad been <br />made to come to an agreement with Mr. Yan'>e who refused to trade a, portion of his <br />la.nd approximately 331.x 761 at the rear of his I.ot for a1l of SA 6C Chac?bournE <br />Drive which woula have given both par-ties a usable Iot. iie also refuseci a.n offer <br />of ?53000 for this same portion of hi5 Iand and su.id he woul.d accept $I0,000 only. <br />In vieta of the fact that a7.1 efforts have f.ailed, it 'was recvested that their <br />request for a rPar ye.rd variance be considered. A portion of the house woulo be <br />only 61 L'rom the lot line due to the irregular sliape of the lot. House plans were <br />studied and it was suggested that if the garage was made flush 4ri.th the house, it <br />could be moved forward 81 thereby increasing the rJistanee froni the rea.r 1_ine to <br />141. Mr. Yanke auestioned the builder on how the d-rainage would be tciken care of. <br />Mr. Biskind said tha.t they wi11 com»ly idth a11 requirements - there is a catch <br />basin at the rear of t,he lot. It was pointec3 out i;hat this is u hardship ca.se since <br />the lot is compl.etely unusable unZess a va.riance is received. The auestion of the <br />remaining 491 of the lots was raised. 14r. Biskind pointed out tha.t it would be to <br />the builc.ers1 advantage to sell it sir3ce they do not hmnt the upkeep a.nd taxes on it. <br />They will try to sell it at a reasonable price to the property owners on each side. <br />A4r. Greene moved to grant a 361 rear yarcl variance for a maximur,i distance af 30t; <br />seconded by Mr. Forcelli.ni and passed. <br />2a Anpellant: pariS Penix' 6074 Porter Road. Continuation of request for varia.nce <br />on present double woven. wire link fence 41 high across rear of <br />property which fronts on Decker Road. <br />R?quest is in violation Of OY'a1.nuT1Ce #62-332 Seetion 1151.04' fence <br />not to exceed 30" in height a.Iong the street line. <br />Present: iMr. Penix <br />A4r. Penex sta.ted that two addi-tional narnes had been added to the petition that they <br />hac1 nresented at the 13.st meeting - those of John Kiertscher and Royce Damron. Member,s <br />of the Board saici tha.t they had looked at the fence in question and asked a.bout a <br />top aupport of sorie kind. Mr. Penex explained that he has the top wire but did not <br />install it after the complaint -?,ms made a.bout his fence. Iie wi1l put it up. Mr. <br />Roberts moved to grant the variance with the req_uest that the owner straighten the <br />posts and stretch the fence as tight as possible in acidition to instAIang the top <br />wire; seconded by Mro Forcellini and passed.
