?'. <br />CYTY OF NORTH OLMSTED - BOARD OF ZONING APPEALS <br />, <br />Regular Meeting Held at City Hall - January 7,1970 <br />The meeting was called to order at 7:30 P.M. by G'h.airman John Roberts. <br />Present: Mrs. Eian, Mssrs. Roberts, Greene, Davis, La.ncashire <br />Also Present: Mayor Ralph Christman, E.J.Gundy, B1dg. Comm. <br />Ser. Dir. C. Watts, Councilman V.Hodgins, & J. Boehmer <br />1. Appellant: James E. Brown, 4532 Clague Road and Ben Arth, 4530 Clague <br />Rd. Continuation of request for variance to erect a barn <br />at rear of existing garage. Request is in violation of <br />Ordinance #62-33, Section 1151.04 (E), accessory Buildings <br />used for housing animals must be located a minimum of 200' <br />from any dwelling. <br />Present: Mr. Brown, Tom Kennedy,Atty. <br />Mrs. Smelko, Mssrs, Bizay, Holland, Koson <br />This case was continued for the purpose of the Board Members making a <br />visual inspection of the property and barn in question. Attorney Tom <br />Kennedy stated he had nothing further to add to information submitted <br />at previous meeting and indicated on the plat the location of the <br />barn to be taken by the State when relocation of Elm Road takes place, <br />and showed location of present garage to which new proposed barn would <br />be attached. <br />Mr. Greene questioned location and asked why barn could not be moved <br />in closer from rear line. Mr. brown stated for looks, and convenience, <br />he wanted permission to attach to existing garage, would need a11 of <br />the rear property to run and practice horses. <br />Chairman Roberts aEi:kea the Mayor if there were any indications when E1m <br />Road wi11 be relocated. Mayor said when right of way is acquired, no <br />plans now for relocation of Elm Rd. Construction of I-80 will be started <br />some time this year. <br />Attorney Kennedy said letter had been received from the Highway Dept. <br />regarding this property Nov. 10,1969, Mr. Bizay and Mr. Holland said <br />they have had no notice from the Highway Dept. regarding their property. <br />Mr. Bizay presented letter to Board with petition attached, indicating <br />that there were no facilities to house animals prior to 1967, and pointed <br />out certain problems that were undesirable, odor from horses, grading <br />problem and unsightly conditions. Mr. Roberts read Mr. Bizay's letter <br />to the Board. Mr. Holland said he objected to the new barn location. <br />Mr. Bizay also presented appraisal records of County Tax Office, whiehi:!_ <br />showed no barn in 1964. Mrs. Smelko stated there never was a horse barn <br />before 1967, she witnessed the barn being put up a few years ago. Mr. <br />Brown said barn was built about 1965, and he had permit for sames Mr. <br />Gundy, Bldg. Comm. said no permit had been issued for barn. Attorney <br />Kennedy said he talked to Highway Dept. today and they said they will <br />be clearing right-a-way where E1m Road is now. <br />Board members made property owners Mssrs. Bizay, Koson, Holland and <br />Mrs. Smelko aware of the fact that if Mr. Brown put barn where it is <br />legally permitted,the location may adversely affect the use of what <br />would then be frontage property on proposed Elm Road. <br />?,?,
