CITY OF NORTH OLMSTED - BOARD OF ZONING APPEAIS <br />Regular Meeting held at City Ha11 - November 3, 1971 <br />The meeting was called to order at 7:35 P.M. by Chairman John Roberts. <br />Those Present: Messrs. Roberts, Tubbs, Scheef, Berglund ?/and Mrs. Eian. <br />Also Present: Mr. Gundy, Building Commissioner <br />The minutes of the 10/6/71 meeting stand approved as written. <br />lo Appellant: Francis Ke11ey, 3685 Walter Rd. - Continuation of request <br />for variance (1133.13) to erect detached garage 14' from adjacent <br />dwelling. Request is in violation of Ord. #62-33, Section 1151.04, <br />which requires a minimum of 20' between detached garage and any <br />dwelling. <br />Present: Mrs. Kelley, Mrso Ruebensaal, Mrs. AZwin, Virginia Hodgins. <br />A11 witnesses were sworn in. Mrs. Kelley presented photos of her property. Mrs. <br />Kelley also presented a letter written by Mrs. Lois Wensink, a neighbor, stating <br />that there would be no objection. Mrs. Ruebensaal and Mrs. Alwin said there <br />would be no objection; the Kelleys are trying to improve their property. Mr. <br />Berglund did not see any problem. Mrs. Kel3:ey stated that if the garage is set <br />back any further, i.t would cut off the play area in the back yard. Mr. Tubbs <br />made a motion to grant a 6' variance; seconded by Mr. Berglund and passed with <br />Mr. Scheef voting no. <br /> <br />2. Appellant: James D. Pierson, 6057 Gareau Dr. - Request for 21 vaxiance <br />(1133.13) to install 40P of fence along the rear north side yard. Request <br />is in violation of Ord. #62-33, Section 1151.04, fence not to exceed 4' in <br />height. <br />Present: Mrs. P3.erson, Mr. Vetronem <br />A11 witnesses were sworn in. A letter from Mrs. Pierson was read by Mr. Roberts. <br />Mrs. Pierson presented a letter from Mr. Ernest Henning, a next door neighbor, <br />stating that he has no objection to the fence. Mrs. Pi.erson said that there has <br />been a problem with young boys playing football on her property. Mr. Vetrone had <br />no objection to the fence. Mrs. Eian moved to grant a 2' variance for a fence on <br />the north side of the rear yard; it was seconded by Mr. Tubbs and unanimously <br />passed, <br />3. Appellant: Jack Rybar, Request to erect dwelling on Per. Parcel 235-74-92 <br />Decker Rd., North Olmsted, S/L 497 with a 4!. side line variance. Request <br />is in violation of Orde #62-33, Section 1161.01, which requires that the <br />sum of the two sides be not less than 201. <br />Present: Mr. & MrS. Rybar. <br />Witnesses were sworn in. Mr, & Mrs. Rybar presented plans. They stated that <br />there is a 40' lot on one side of their property and an 80' lot on the other <br />side. Mr. Roberts asked Mr. Gundy if the square footage was adequate for the <br />lot size, Mr. Gundy said it was. Mre Scheef asked Mr. Gundy if this is an <br />area that has mixed lot sizes. He was told it is. Nr. Tubbs made a motion <br />to grant a41 variance; it was seconded by Mr. Scheef and unanimously passed.
