.??. <br />CITY OF NORTH OLMSTED - BOARD OF ZONING APPEALS <br />Regular Meeting held at City Ha11 - September 22, 1971 <br />The meeting was called to order at 7:30 P.M. by Chairman John Roberts. <br />is Those Present: Mr. Roberts, Mr. Tubbs, Mrs. Eian, Mr. Bergl.und. <br />A1so Present: Mr. Gundy, Bu3.lding Commissioner <br />1. Appellant: Raphael Frangello, 3019 Clague Rd. - Continuation of request <br />for variance (1133m13) to erect detached garage too close to street line <br />on corner 1ot. Request is in violation of Ordinance #62-33, Section <br />1159.02, which requires a 25' minimum setbacko <br />Present: Mr. Raphael Frangello. <br />Mr. Frangello was sworn in. A letter written by Mr. Frangello was reade He stated <br />that the??,li-are two trees on his property that limit the space where he can erect <br />the garage. He plans on using the same driveway, except he will make a concrete <br />apron where the former garage wass Mr. Frangello also stated that if he doesn't <br />erect the garage where he proposes, there wi11 be no play area for his children. <br />Mr. Tubbs made a motion to grant a variance to erect a garage l02 feet from the <br />side of Alexander Road. Mr. Berglund seconded the motion, and it was unanimously <br />passed. <br />2. Appellant: First Universalist Church of Olmsted, 5050 Porter Rd. - <br />? Continuation of request for variance (1133.13) to erect 64' of 6' fence <br />from end of stone wa11 to property line and then west along portion of <br />property line. Request is in violation of Ordinance #62-33, Section <br />1151.04, fence not to exceed 4' in height. <br />Present: Mrsm Soko1, Mrs. Hawk, Mrs. Dyer, adjacent property owners. <br />All witnesses were sworn in. A11 tYie witnesses stated that they do not feel the <br />fence would be of any benef it to the property owners. Mro Tubbs stated that if the <br />neighbors are opposed to the fence he doesn't see any reason f or granting variance. <br />Mr. Tubbs made a motion to deny request for a 6' fence. Mr. Berglund seconded the <br />motion. The request was denied unanimously. <br />3s Appellant: Lawson Mi1k Co. - Request to erect store on S/L 49 McKenzie R.d.. <br />Violation of Ordinance #62-33, Section 1141.04 which states that no lot <br />sha11 be considered to be within Local Retail Business District or General <br />Retail Business District unless same has a frontage of at least 50' on <br />Lorain or Brookpark Roads, <br />Present: Mr. Minderhout, property owner, Mr. UJooten representing Mr. Minderhout. <br />? A11 witnesse_s were sworn in. AZr. Wooten stated that Mr. Minderhout has owned this <br />property for a number of years. It had been zoned commercial and he has paid taxes <br />on commercial property. In 1964 an ordinance was passed stating that any property <br />that is to be commercial should have a 50' entrance on Lorain or Brookpark road. <br />?
