City of North 013nsted <br />BOARD OF ZONING APPEALS <br />November 8, 1973 <br />Meeting was called to order by Chairman Roberts at 7:30 p.m. <br />The follotaing members were present: Chairman Roberts, Vice Chairman Hamill, <br />Messrs. Duskey and Tubbs and Mrs. Eian. <br />Also present: Pr. Gundy Building Commissioner, Recording Secretary Virginia <br />Hodgins and Councilmen Boehmer, Speedling and Saringer. <br />l, Mrs. Frank H. Moore, 6679 Maplehurst Dr. Request for variance (1133.13) <br />Request for 3 ft. height variance for existing privet hedge. Violation <br />of Orde 62-33 Section 1151.04e <br />Mrs. Moore, Councilman Boehmer and neighbors were administered the <br />oath. There was considerable discussion as to maintenance of hedge, <br />its location and suggestion of higher fence around swimming pool. <br />Mr. Tubbs moved to tontinue the case. Mr. Hamill seconded and mo- <br />tion passed. <br />2. Bag°dey Schwarzer, Pres., Modern Homes and Bldg., Inc. 21990 Lflrain Rda, <br />Fairview Park, Ohio 44126. Request for variance (1133.13). Request <br />to build Retail Center at Park Ridge Dr. and Lorain Rd. (28669 Lorain). <br />Hearing required on basis of Section 1215.01 of Ord. 62-33• <br />Mr. Schwarzer, his attorney, Councilmen Boehmer and Speedling and Robert <br />Kelly, Traffic Consultant were administered the oath. Neighbors Butler, <br />Napik, Cranston and others were adminstered the oath also. Mr. Sclzwarzer <br />explained plans which meet code in every respect; driveways, parking, set- <br />back, planting strip, storage facilities. No variance is required. Plan- <br />ning Commission should review off street parking. Planning Commission did <br />not approve. The lawyer stated traffic is the main problem. Traffic expert <br />Kelly testified the 711 store across the street has the same problem. It <br />threatened to go to court and then acquired permission to build. He recom- <br />mends driveways on Park Ridge Drivee This is under the city's jurisdic- <br />tion. At this point there is no cut through. Area is zoned for use be- <br />ing planned. There are to be 3 daytime businesses and 2 night businesses <br />and 55 parking spaces. Mr. Speedling explained t he property development <br />across the street. Mr. Speedling was present at BZD committee meeting when <br />Park Ridge Retail Center was presented and the developer would not cooperate <br />with suggestions made. Mr. Gundy read the details of the ordinance -- <br />Council does have obligations regarding traffic. South of Park Ridge resi- <br />dents could use the shopping center for short cut. Mr. Butler inquired <br />a1mut turn around for trucks. Mrsm Napik objected because of traffic. <br />iMr. Boehmer agreed with Mr. Speedling's statement and restated problems <br />as outlined in BZD Committee. The lawyer suggested Council erred, but <br />the plan never got to Council. Mr. Tubbs movec3 to continue in regard <br />to examination of plans by Safety Director Carnahan and examination b?r <br />Law Director.
