City of Nort2i 0lmsted <br />BOARD OF ZONING APPEAIS <br />February 6, 1974 <br />Chairman Hamill called the meeting to order at 7s30 p.m. <br />Present: Messrs. Roberts., Duskey, Tubbs, Ledvina and Chairman Hamill. <br />Also present: Law Director Gareau, Building Commissioner Gundy and Record- <br />ing Secretary Hodgins. <br />Mre Roberts moved for approval of Annual Report for 1973. Mr. Duskey "seconded <br />and motion passed unanimouslye <br />Continuance of hearing of request of Mrss Frank H. Moore, 6679 Maplehurst <br />Drive for varia.nce (1133o13)e Request for 3 fte hei?ht variance for exist- <br />ing privet hedge. Violation of Ord. 62>33 Section 1151.04o Also request <br />for 7 ftv fence - violation of Ord. 62-33 Section 1151.0L Par. H. <br />Present: Councilman Dolores D. Sharpe, <br />iqr. Moore and his attorney, Frank Lord and neighbors oof i"irr o Moore o <br />Witnesses were administered the oath. Letter from Attorney Lord <br />to Building Commissioner Gundy was reviewed by Board members. <br />Letter urged passage of approval of privet hedge and installa- <br />tion of 7 ft. fence. Petition containing 31 signatures was <br />attached to letter. Proposal is for 7 ft. fence across back <br />and along the side of Moore property. Addition is to be made <br />to house thus eliminating need of fence in area of additiona <br />48 inches is height of fence required around a pool. L8 ft. <br />fence can be adjacent to pool or around property line. The <br />Moore pool is in the ground. It is 12 ft. -frorn pool to fence. <br />Mrs. Beyer spoke regarding height of homes and good visibilityo <br />She objects to 7 ft. hedge and 7 ft. fence. Request is to pre- <br />vent hazard. Zoss of privet hedge has caused aggrevation. Pool <br />was built several years ago. Neighborhood disagreement began <br />last year. Councilman Sharpe stated she would appreciate con- <br />sideration of request. Mr. Tubbs moved to grant 1 ft. fence <br />variance to allow 5 ft. fence per plan and shrubbery be allow- <br />ed to reach height of 7 ft. and to be maintained within property <br />line. Mr. Duskey seconded. All members present voted aye ex- <br />cept Mr. Roberts who -abstained. <br />l. John•Ra h'elker, 5567 Revere Dr. Request for variance (1133.13). Request <br />for 14 ft. front setback variance. Violation of Ord. 62-33 Section 1159s01, <br />Presents Mr. Welker who was administered the oath. Request was read and <br />plans examined. Neighbors had been contacted and had no objec- <br />tion. Home is 12 years old and in non conforming inasmuch as <br />it has 35 ft. rear yard. Lot is 8!t ft. x 130 ft. and is a Bauer <br />built home. Mr. Tubbs moved case be continued pending notif ica- <br />tion of all parties concernedm Mr. Roberts seconded and motion <br />passed, <br />Recyeled Bond - One step to eave our envuonment
