BOARD OF ZONING APPEALS <br />CI'I'Y OF NORTH OLIVIST'ED <br />MINUTES FOR NOVEMBER 1, 2012 <br />ROLL CALL <br />Ms. Rudolph called the meeting to order at 7:03 p.m. in Council Chambers and led the Pledge of <br />Allegiance. <br />Present: Jennifer Rudolph, Maureen Diver, Laura Bellido, Michael Raig <br />Absent: Alfredo Lopez <br />Staff: Law Director Michael Gaseau, Jr., Building Commissioner James McReynolds, Clerlc <br />of Commissions Doruza Rote <br />A momPnt of silence was observed for the passing of Building Commissioner Dale Mitchell. <br />12EVIEW AND CORRECTION OF MINUTES <br />Ms. Diver moved, seconded by Ms. Bellido, to approve the September 6, 2012 minutes, <br />which passed 3-0 with Mr. Raig abstaining. <br />RESIDENTIAL APPEALS AND REQUESTS <br />Jennifer Dennison; 4362 Porter 12oad <br />Proposal consists of a fence and the following variance is requested: an 18 inch variance for a 4 <br />foot chainlinlc fence located within the 50 foot front setbaclc of the neighbors house on a corner <br />lot; code allows 30", applicant shows 48", section 1135.02 f2. <br />Jennifer Dennison and Mr. Dennison were administered the oath. Ms. Dennison said her home is <br />on Porter Road which is a busy street. The fence will ensure her child and pets are safe. Mr. <br />Dennison said the home was built in 1957 and met all zoning code requirements however once <br />Camellia Lane was developed in the 60's the setbaclc changed to 13 feet. If a fence was installed <br />to code most of the yard would be outside the fence. The fence will be in line with the edge of <br />the home and placed inside a row of trees. Mr. McReynolds said he has no objections to the <br />fence as it is 50% open, it creates no safety issues. Ms. Rudolph aslced if the request was for the <br />height of the fence or setbaclc and Mr. McReynolds said the variance is for setback. Members <br />had no objections the fence created no safety hazards and would be more than 50% open. <br />Ms. Rudolph tnoved, seconded by Ms. I)iver, to grant Jennifer Dennison of 4362 Porter <br />Road a variance for a 4 foot chainlinlc fence beyond the front lbuilding line of the abutting <br />property, code permits a fence no greater than 30 inches in height and 50% open applicant <br />shows a 4 foot chainlanlc fence more than 50% open, section 1135.02(f)(1), which passed 4-0. <br />Melodv Piorlcowski; 5854 Stearns Road <br />Proposal consists of an air conditioner. The following variance is requested: a 2 foot 2 inch <br />variance for side yard setbaclc, code requires 5 feet; applicant shows 3' 10", section 1135.09.
