BOARD OF ZONING APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES OF OCTOBER 7, 2013 <br />ROLL CALL <br />Ms. Rudolph called the meeting to order at 7:00 p.m. in Council Chambers and led the Pledge of <br />Allegiance. <br />Present: Jennifer Rudolph, Maureen Diver, Laura Bellido <br />Absent: Michael Raig, Alfredo Lopez <br />Staff: Director of Law Michael Gareau Jr., Clerk of Commissions Donna Rote <br />REVIEW ANI) CORRECTION OF MINUTES <br />Ms. I)iver moved, seconded by Ms. Rudolph, to approve the minutes of September 9, 2013 <br />which passed 3-0. <br />RESIDENTIAL APPEALS AND REQUESTS <br />CMS13-32: Rita & Sally Winson; 6666 Barton Road <br />Proposal consists of a new detached garage. The following variance is requested: <br />1. A 306 sq ft variance for an attached & detached garage in combination; code permits 750 sq <br />ft, applicant shows a total of 1,056 sq ft, Section 1135.02(c)(3). <br />Notes: 1. Existing attached garage is 480 sq ft, proposed detached garage is 572 sq ft. 2. A <br />violation was issued to remove two inoperative vehicles and to replace a dilapidated fence. <br />The oath was administered to Rita and Sally Winson, contractor John Damico and neighbors Mr. <br />and Mrs. Fulop. Ms. Winson said the second garage is needed to accommodate vehicles and <br />yard tools. Mr. Damico said the 26 x 22 garage with a four twelve pitched roof is a standard size <br />garage and will include a concrete driveway. Mr. Fulop said the placement of the garage is close <br />to his property line and the plans don't show downspouts or how the water will be maintained in <br />their yard. The neighbor's addition already drains into his yard causing it to flood and adding a <br />second garage and driveway will exacerbate the flooding. There is a common swale between the <br />two homes which can't handle the existing runoff/overflow now. The dilapidated fence and <br />proposed garage will adversely affect his property therefore he request the board deny the <br />variance. Ms. Winson said the addition is properly drained and the garage will be as well. Mr. <br />Fulop said the owners have two acres of land the garage can be placed elsewhere on their <br />property. Ms. Winson said the fence is two feet away from the swale and the placement of the <br />garage was chosen to minimize the amount of concrete drive which has to be added. The garage <br />could be moved inward from the swale a few feet if preferred. Mr. Damico said different layouts <br />for the garage were explored including having it attached to the existing garage however the <br />grade would have to be raised to be level with the house and would create more runoff towards <br />the Fulla's yard. The new garage will not be elevated and properly drained so runoff will be <br />minimal. Mr. Fulop suggested placing the new garage directly behind the existing garage. Ms. <br />Rudolph said regardless of the garage location the owners would be required to maintain water <br />on their own property. Ms. Winson said they were open to moving the garage inward however
