. <br />BOARD OF ZONING APPEALS <br />CITY OF NORTH OLIVISTED <br />MINUTES OF SEP'I'EMBER 8, 2014 <br />ROLL CALL <br />Ms. Rudolph called the meeting to order at 7:03 p.m. in Council Chambers and led the Pledge of <br />Allegiance. <br />Present: Jennifer Rudolph, Michael Raig, Laura Bellido, Eric Allain, Bob Papotto <br />Staff: Assistant Law Director Bryan O'Malley, Assistant Building Commissioner Daniel <br />Russell, Clerk of Commissions Donna Rote REVIEW AND CORRECTI0N OF MINUTES <br /> <br />Ms. Bellido moved, seconded by Mr.l2aig, to approve the minutes of July 7, 2014 and <br />August 4, 2014, whieh passed 5-0. <br />RESIDENTIAL APPELAS AND REQUES7CS <br />App14-1808:William Healv; 26760 Ross Cirele: <br />Proposal consists of a sunroom. A special permit to add to a non-conforming building is <br />required; existing hoine is 36 ft. from the rear property line, chapter 1165.02. <br />The following variances are required: • <br />1. A 22 ft. variance for rear yard setback is requested; code requires 50 ft., applicant shows 28 <br />ft., Section 1135.08 (a). Note: existing rear yard setbaclc is 36ft. <br />2. A variance for one additional shed; code permits 1, applicant shows 2, section 1135.02 <br />(d)(1). <br />3. A 56 square foot variance for maximum allowable square footage of an accessory structure; <br />code permits 120 sq, ft., applicant shows 176 sq. ft., section 1135.02 (b)(1). <br />4. A 227 square foot variance for exceeding 20% rear lot coverage; code allows 1171 sq. ft., <br />applicant shows 1398 sq. ft., section 1135.02 (d)(3). <br />The oath was administered to Mr. Healy. He said they have a sunlcen family room along the <br />back of the home which connects to a sunlcen patio. The patio foundation was installed when the <br />home was first built. During heavy rain the patio floods into the family room. They would lilce to <br />enclose the sunlcen patio to help address the flooding issues occurring. The enclosure will be a <br />three season room. Mr. Russell said he had no objections but noted there were an extensive <br />amount of variances required. Ms. Rudolph questioned the variance for a shed. Mr. Russell said <br />the plans submitted by the contractor showed all structures on the lot. There are three sheds on <br />the lot, one was granted a variance and one is plastic which is not considered a permanent <br />structure. The shed located in the northwest corner was added onto without a permit and creates <br />the need for the additional variances. Ms. Rudolph asked why there was a need for two sheds and <br />Mr. Healy said one is for yard tools and the other is for storing outdoor fiirniture during the <br />winter months. He said that if the addition is approved he could remove the plastic shed if <br />required. Mr. Russell said the variances listed would not change removing the plastic shed as it <br />isn't a permanent structure. Ms. Bellido said the yard did not appear to be over crowded when
