a <br />'_. t • <br />BOARD OF ZONI1oTG APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES OF FEBRUARY 3, 2014 <br />ROL,L CAI.L <br />Ms. Rudolph called the meeting to order at 7:07 p.m. in Council Chambers and led the Pledge of <br />Allegiance. <br />Present: Jennifer Rudolph, Laura Bellido, Michael Raig <br />Absent: Alfredo Lopez <br />Staff: Planning and Development Director Kim Wenger, Building Commissioner Jeff <br />Grusenmeyer, Clerk of Commissions Donna Rote <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Raig moved, seconded by Ms. Rudolph, to approve the BZA minutes of January 6, 2014 <br />which passed 3-0. <br />COMMERCIAL APPEALS AND REQUESTS <br />CMS 13-42: Kensington Court Apartments; 23307 Lorain Road <br />Proposal consists of construction of a new pool and commtu-lity building with site improvements. <br />Parcel is split zoned General Retail Business and Single Residence C. The following variances are <br />requested: <br />l. A 54 ft. variance for side setback to recreational use (west adjacent to C One Family Residence <br />District), 100 ft. required, 46 ft. provided, Section 1118.04(a)(2). <br />2. A 53 ft. variance for rear setback to recreational use (south adjacent to C One Family Residence <br />District), 100 ft. required, 47 ft. provided, Section 1118.04(a)(2). <br />3. A 57 ft. variance for side setback to recreational use (east adjacent to C One Family Residence <br />District), 100 ft. required, 43 ft. provided, Section 1118.04(a)(2). <br />4. A 2 foot variance for height of fence, 6 ft. permitted, 8 ft. shovm, Section 1135.02(fl(1). <br />Note: Parking may require a variance but additional information on the number of units in the <br />development and use areas of the building and pool/deck area is required to calculate this item. <br />Project representative Ron Kluclun and neighbor Jeff Sturgeon were administered the oath. Mr. <br />Kluchin said they would like to construct a new club house and pool. However due to the split <br />zoning of the lot and setback requirements they are unable to use the property without variances. <br />The new building will be 2,500 square feet and the poo' will include an aluminum fence. The city <br />forester has requested the majority of the trees along the rear property be removed so they will be <br />replaced with an 8 foot 1-ugh fence with an access gate and evergreens to provide buffering. The <br />existing pool will be removed and replaced with landscaping and additional parking spaces. The <br />new owners are working to upgrade the site and buffer neighboring residents. Mr. Sturgeon was <br />concerned the project was too close to the homes, including his mother's which is southwest of the <br />site. He requested the fence be continued around the southwest side of the lot to provide additional <br />buffering to her home and suggested placing the fence on top of mounding. He said the rear ditch <br />was filled with debris and needed to be cleaned. Mr. Kluchin said they are open to continuing the
