- + <br />BOARD OF ZONING APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES OF SEPTEMBER 14, 2015 <br />ROLL CALL <br />Ms. Rudolph called the meeting to order at 7:00 p.m. in Council Chambers and led the Pledge of <br />Allegiance. <br />Present: Jennifer Rudolph, Laura Bellido, Bob Papotto, Eric Allain, Michael Raig <br />Staff: Law Director Michael Gareau, Jr., Assistant Building Commissioner Daniel <br />Russell, Clerk of Commissions Donna Rote <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Allain moved, seconded by Mr. Raig, to approve the Board of Zoning Appeals minutes <br />of August 3, 2015, motion passed 5-0. <br />RESIDENTIAL APPEALS AND REQUEST <br />15-2640: Ryan Kinlev; 30940 Lorain Rd. <br />Proposal consists of a detached garage. The following variance is requested: <br />1. A 1 ft. variance for the height of the garage; code requires 15 ft., applicant shows 16 ft., <br />Section 1135.02(c)(1). The oath was administered to Ryan Kinley and contractor Jerry Kilby. Mr. Kinley said the rental <br />home is required to have a garage and the garage will be 30'x 24'. Mr. Raig asked how the rental <br />home would access the proposed garage as the entrance faces north away from the home and <br />appears the gravel drive is on another parcel. Mr. Kilby said the layout of the garage was <br />designed around the topography of the site which slops to the north. The home can access the <br />garage without crossing the parcel line as the gravel will be expanded. Ms. Rudolph asked if the <br />drive would be paved and why the garage couldn't meet code. Mr. Kilby said the height of the <br />garage is due to having an extra course on the foundation to ensure the wood framing is above <br />the water table. Mr. Kinley said the garage will be used for the rental home only. Mr. Russell <br />said looking at the garage from Lorain Road the garage will be the proper height only the north <br />side of the garage is higher due to the slope. Mr. Allain said he has a concern that the proposed <br />garage will be used for the owner's commercial use. However the hardship is due to the <br />topography which slopes to the rear of the lot. <br />Ms. Rudolph moved, seconded by Ms. Bellido, to grant 15-2640: Ryan Kinley of 30940 <br />Lorain Road a 1 ft. variance for the height of the garage; code requires 15 ft., applicant <br />shows 16 ft., Section 1135.02(c)(1), motion passed 5-0. <br />15-4270: Michael & Danielle Edel; 27373 Linwood Circle ' <br />Proposal consists of a shed. The following variances are requested: <br />l. A 72 sq. ft. variance for a shed; code permits 120 sq. ft., applicant shows 192 sq. ft., Section <br />1135.02(d)(1).
