BUILDING & ZONING BOARD OF APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES OF AUGUST 1, 2016 <br />ROLL CALL <br />Chairman Raig called the meeting to order at 7:05 pm in Council Chambers and led the Pledge <br />of Allegiance. <br />Present: Michael Raig, Bob Papotto, Melissa Meredith, Eric Allain <br />Absent: Donna Sabo <br />Staf£ Assistant Law Director Bryan O'Malley, Assistant Building Commissioner Dan Russell, <br />Planner James Aspery, Administrative Assistant Nicole Rambo <br />REVIEW AND CORI2ECTIOlei OF MIIVUTES <br />Ms. Meredith moved, seconded by Mr. Allain, to approve the Building & Zoning Board of <br />Appeals minutes of July 11, 2016, motion passed 4-0. <br />RESIDENTIAL APPEALS AND REQUESTS <br />16-6509; Lisa O'Donnell; 4017 Darbv Lane <br />Representative: Lisa O'Donnell, owner <br />Proposal consists of fencing. The property is zoned One Family Residence A. <br />The following variances are required: <br />1. A variance for a 6 ft. high fence located on a corner lot within the front building setback of <br />the abutting lot on the side street; code does not allow, applicant shows a 4 ft. high fence on a <br />corner lot within the front building setback of the abutting lot, Section 1135.02(fl(2). <br />2. A variance for a solid fence in the front building setback; code permits 50% open fence, <br />applicant shows a solid vinyl fence, Section 1135.02(fl(1). <br />3. A 42 in. variance for a 6 ft. high fence in the front building setback; code permits 30 in., <br />applicant shows 72 in., Section 1135.02(f)(1). <br />Mr. Aspery stated that the property is at the intersection of Darby Lane and Park Place with <br />frontage on Park Place, and the applicant has requested a variance to allow a 6 ft. solid fence <br />within the front setback of the abutting lot on the side street. The first variance should state that <br />the applicant shows a 6 ft. high fence. A setback of 24 feet from the sidewalk is proposed. Code <br />allows a fence in the front building setback (50 feet) so long as it is 50% open and no more than <br />30 inches high. Therefore the applicant's proposed fence requires variances addressing both of <br />these requirements. The proposed fence would enclose the back yard area and connect to the <br />existing fence along the neighboring property line to the east. Ms. O'Donnell stated that the <br />fence would be the same height as the neighbor's fence and she believed it would increase the <br />property value. In addition to providing privacy, the fence would help contain her large dogs. <br />Mr. Papotto clarified that the applicant would not be installing fencing along the existing <br />neighbor's fence. Mr. Raig added that the Illuminating Company was okay with the fence being <br />installed in their easement per the letter submitted with the case file.
