BUILDING & ZONING BOARD OF APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES OF JULY 11, 2016 <br />ROLL CALL <br />Chairman Raig called the meeting to order at 7:00 pm in Council Chambers and led the Pledge <br />of Allegiance. <br />Present: Michael Raig, Bob Papotto, Melissa Meredith, Eric Allain <br />Absent: Donna Sabo <br />Staff: Assistant Law Director Bryan 0'Malley, Planner James Aspery, Administrative Assistant <br />Nicole Rambo <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Papotto moved, seconded by Mr. Allain, to approve the Building & Zoning Board of <br />Appeals minutes of June 6, 2016, motion passed 4-0. <br />RESIDENTIAL APPEALS AND REQUESTS <br />16-6252; Marv Jane Colleran; 5086 Whitethorn Ave <br />Representatives: Dan Colleran, son of owner; Daniel Parker, grandson of owner <br />Proposal consists of a 12' x 16' rear deck. The property is zoned One Family Residence B. <br />The following variance is requested: <br />1. A 9.5 ft. variance for a rear yard setback; code requires 50 ft., applicant shows 40.5 ft., <br />Section 1135.08. <br />Mr. Aspery stated that the applicant is requesting a variance of 9.5 feet to allow for the addition <br />of a 12 ft. by 16 ft. deck to the rear of their existing home. The proposed deck would replace the <br />existing 6 ft. by 10 ft. porch. The current rear yard setback is 46.5 feet, which is nonconforming, <br />and the proposed porch would further reduce this number to 40.5 feet. Code requires a rear yard <br />setback of no less than 50 feet. Mr. Golleran stated that the owner fell on the existing porch due <br />to no handrails being present. Mr. Parker wanted to install a deck in the back to correct the height <br />of the existing step and make the home more accessible for the owner. Mr. Parker added that the <br />adj acent property owners support the proj ect to allow the owner to have more accessibility to her <br />home. Ms. Meredith questioned the dimensions of the deck. Mr. Parker stated that the existing <br />cement step will remain and a second step will be added. Mr. Allain pointed out that the extra <br />foot on the dimensions accounts for the step. Ms. Meredith said a variance would be required no <br />matter what for a deck in the backyard. <br />Ms. Meredith moved, seconded by Mr. Allain, to grant the following variance as written for <br />16-6252; Mary Colleran; 5086 Whitethorn Ave: <br />1. A 9.5 ft. variance for a rear yard setback; code requires 50 ft., applicant shows 40.5 ft., <br />Section 1135.08. <br />Motion passed 4-0.
