BUILDING & ZONING SOARD OF APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES OF APRIL 3, 2017 <br />ROLL CALL <br />Vice Chairman Allain called the meeting to order at 7:02 pm in Council Chambers and led the <br />Pledge of Allegiance. <br />Present: Bob Papotto, Eric Allain, Ralph Mackey <br />Absent: Michael Raig <br />Staff: Law Director Michael Gareau, Assistant Building Commissioner Dan Russell, Planner <br />James Aspery, Administrative Assistant Nicole Rambo-Ackerman <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Mackey moved, seconded by Mr. Allain, to table the Building & Zoning Board of <br />Appeals minutes of January 9, 2017, motion passed 3-0. <br />RESIDENTIAL APPEALS AND REQUESTS . <br />17-8029; Mohamed Ali & Nazha Abughali; 5464 Jacqueline Lane <br />Representatives: Nazha Abughali and Mohamed Ali, owners <br />Proposal consists of a pergola in the side yard. The property is zoned One Family Residence B. <br />The following variances are requested: <br />1. A 1 ft. variance for side yard setback; code requires 5 ft., applicant shows 4 ft., Section <br />1135.07. <br />2. A 6 ft. variance for combination of side yards with an attached garage; code requires 15 ft., <br />applicant shows 9 ft., Section 1135.07. <br />Applicants requested to be tabled due to only having three board members present. <br />Mr. Mackey moved, seconded by Mr. Allain, to table 17-8029; Mohamed Ali & Nazha <br />Abughali; 5464 Jacqueline Lane until the next meeting, motion passed 3-0. <br />17-8073; Melvin Lonez; 24909 Antler Drive <br />Representatives: Melvin Lopez, owner; Jim Baker, contractor <br />Proposal consists of a deck in the rear yard. The property is zoned One Family Residence C. The <br />following variance is requested: <br />1. A 20 ft. variance for rear yard setback; code requires 50 ft., applicant shows 30 ft., Section <br />1135.08(a). <br />Mr. Aspery said the applicant is requesting a variance of 20 feet to allow for the addition of a <br />deck 14 feet wide by 10 feet deep to the rear of their existing home. The current rear setback is <br />40 feet, which is already a nonconforming distance, and the proposed porch would further reduce <br />this setback number to 30 feet. Code requires a rear yard setback of no less than 50 feet.
