BUILDING & ZONING BOARD OF APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES FOR SPECIAL MEETING OF MAY 15, 2017 <br />ROLL CALL <br />Chairman Raig called the meeting to order at 7:01 pm in Council Chambers and led the Pledge <br />of Allegiance. <br />Present: Michael Raig, Bob Papotto, Ralph Mackey, Eric Allain <br />Staff: Assistant Building Commissioner Dan Russell, Planner James Aspery, Administrative <br />Assistant Nicole Rambo-Ackerman <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Allain moved, seconded by Mr. Papotto, to approve the Building & Zoning Board of <br />Appeals minutes of January 9, 2017 as written, mation passed 3-0, Mr. Mackey abstained. <br />Mr. Allain moved, seconded by Mr. Mackey, to approve the Building & Zoning Board of <br />Appeals minutes of Apri13, 2017 as written, motion passed 3-0, Mr. Raig abstained. <br />RESIDENTIAL APPEALS AND REQUESTS <br />17-8029; Mohamed Ali & Nazha Abughali; 5464 Jacqueline Lane <br />Representatives: Mohamed Ali and Nazha Abughali, owners; James Pavlosky, 5460 Jacqueline <br />Lane <br />Proposal consists of a pergola in the side yard. The property is zoned One Family Residence B. <br />The following variances are requested: <br />1. A 1 ft. variance for side yard setback; code requires 5 ft., applicant shows 4 ft., Section <br />1135.07. <br />2. A 6 ft. variance for combination of side yards with an attached garage; code requires 15 ft., <br />applicant shows 9 ft., Section 1135.07. <br />Note: Applicant requested to be tabled at Apri13, 2017 meeting. <br />Mr. Aspery stated that the applicant is requesting variances to retain an existing pergola that has <br />been constructed off of their home's northern exterior wall. Code requires the minimum width of <br />the side yard to be not less than five feet on one side. The applicant shows four feet from the <br />pergola corner. Additionally, in the case of a dwelling that is designed to have an attached <br />garage, such as the applicant's home, the sum of the two side yards shall not be less than 15 feet. <br />The applicant currently shows a combined side yard sum of nine feet: four feet on the northern <br />side yard and five feet on the southern side yard. Variances will be required for the pergola to <br />remain in its current footprint. <br />Mr. Ali stated that the project began three years ago when he wanted to build a carport. The <br />applicant installed six by six inch wood posts and the project changed to a pergola after he found <br />out that the carport was not allowed. The pergola was then installed as part of a larger <br />landscaping project. He would like the variance because it would be a hardship to change it and
