BUILDING & ZONING BOARD OF <br />APPEALS CITY OF NORTH OLMSTED <br />MINUTES FOR THE SPECIAL MEETING OF AUGUST 21, 2017 <br />ROLL CALL <br />Chairman Raig called the meeting to order at 7:03 pm in Council Chambers and led the Pledge <br />of Allegiance. . <br />Present: Michael Raig, Bob Papotto, Ralph Mackey, Eric Allain <br />Staff: Assistant Law Director Bryan O'Malley, Assistant Building Commissioner Dan Russell, <br />Planner James Aspery, Administrative Assistant Nicole Rambo-Ackerman <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Allain moved, seconded by Mr. Mackey, to approve the Building & Zoning Board of <br />Appeals minutes of July 3, 2017 as written, motion passed 4-0. <br />RESIDENTIAL APPEALS AND REQUESTS <br />17-9162; Robert & Maria Krihwan; 24129 Salzburg Circle <br />Representatives: Robert & Maria Krihwan, applicants; Jason Cassidy, Drees Homes; Ursula <br />Kiss, owner; Linus Muliolius, owner's realtor <br />Proposal consists of a new home. The property is zoned One Family Residence C. <br />The following variance is requested: <br />1. A 15 ft. variance for rear yard setback; code requires 50 ft., applicant shows 35 ft., Section <br />1135.08(a). <br />Mr. Aspery stated that the applicant is proposing to construct a new house. As proposed, the <br />house impedes on the required rear yard setback by 15 feet. Code requires a rear yard setback of <br />50 feet, whereas the applicant shows 35 feet. Mr. Cassidy pointed out that the lot has a shallow <br />building footprint due to the setback from the cul-de-sac. The challenge was to find a 30 foot <br />deep house that would fit in with the neighborhood. Ms. Krihwan added that they love the area <br />and by using Drees, she hoped that the home would fit in with the neighborhood. There are no <br />homes behind the lot that would be affected. Mr. Muliolius stated that the owner's father is ill <br />and needs to sell the property in order to buy a home that will accommodate their family's needs. <br />The shape of the lot impeded the current owner from building an accessible home. Mr. Mackey <br />agreed that the lot is difficult to build on. <br />Mr. Allain moved, seconded by Mr. Papotto, to grant the following variance as written for <br />17-9162; Robert & Maria Krihwan; 24129 Salzburg Circle: <br />1. A 15 ft. variance for rear yard setback; code requires 50 ft., applicant shows 35 ft., <br />Section 1135.08(a). <br />Motion passed 4-0. - <br />17-9275; Yogesh Chokskv; 23628 Delmere Drive <br />Representatives: Ryan Bell, Champion Windows
