BUILDING & ZONING BOARD OF APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES OF NOVEMBER 5, 2018 <br />ROLL CALL <br />Chairman Raig called the meeting to order at 7:02 pm in Council Chambers and led the Pledge <br />of Allegiance. <br />Present: Mike Raig, Bob Papotto, Ralph Mackey, Dan Rahm <br />Absent: Eric Allain <br />Staff: Law Director Michael Gareau, Jr., Building Commissioner Jeff Grusenmeyer, Planner <br />James Aspery, Administrative Assistant Nicole Rambo-Ackerman <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Papotto moved, seconded by Mr.1Vlackey, to approve the Building and Zoning Board <br />of Appeals minutes of October 1, 2018, motion passed 4-0. <br />RESIDEleTTIAL APPEALS AND REQUESTS <br />18-12349; Thomas & Donna Harlan; 24735 Deerfield Drive <br />Representatives: Thomas & Donna Harlan <br />Proposal consists of a new deck. Property is zoned C-One Family Residence. <br />The following variance is requested: <br />1. A variance for a detached accessory structure (deck) in the side yard; code requires accessory <br />structures to be located in rear yards only, applicant shows an accessory structure (deck) in <br />the side yard; Section 1135.02(C)(1). <br />Note: Property is a corner lot. <br />Mr. Aspery said the applicant is proposing to install a detached deck to the side of their home <br />situated on the corner of Deerfield and Hunter Drives. Code states that corner lots have two front <br />yards, a primary and a secondary front yard, which is why Hunter Drive is considered the front <br />yard despite the home's address and orientation. Given this determination, the proposed deck is <br />located entirely within the side yard. The code requires accessory structures to be located in rear <br />yards only. Mr. Harlan stated that the front door of his home is on Deerfield Drive so he <br />considers the proposed deck to be in the rear yard. Ms. Harlan added that the deck will cover the <br />existing concrete pad and will last longer than the outdoor carpet they have been using. Mr. <br />Mackey asked if the existing concrete pad affected water runoff onto the neighbor's property, <br />Ms. Harlan said it does not. Mr. Mackey asked about the legal address of the property. Mr. <br />Gareau stated that the address is determined by the city and is not a legal concern. Mr. Aspery <br />stated that the narrowest part of the lot is considered the front yard and the 50 foot setback is <br />similar to the setback of most houses. Mr. Grusenmeyer explained that the shorter of the two <br />rights-of-way is considered to be the front yard and the location of the front door does not <br />determine the property frontage. Mr. Rahm confirmed with the applicant that the deck would <br />extend the length of the house, stopping at the air conditioner.
