r <br />BUILDING & ZONING BOARD OF APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES OF MARCH 5, 2018 <br />ROLL CALL <br />Vice Chairman Allain called the meeting to order at 7:06 pm in Council Chambers and led the <br />Pledge of Allegiance. <br />Present: Eric Allain, Bob Papotto, Ralph Mackey, Dan Rahm <br />Absent: Mike Raig <br />Staf£ Law Director Michael Gareau, Jr., Assistant Building Commissioner Dan Russell, Planner <br />James Aspery, Administrative Assistant Nicole Rambo-Ackerman <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Papotto moved, seconded by Mr. Allain, to approve the Building & Zoning Board of <br />Appeals meeting minutes of February 5, 2018, motion approved 4-0. <br />RESIDENTIAL APPEALS AND REQUESTS <br />18-10581; Walter Hollv; 26165 Kennedv Ridge Road <br />Representatives: Walter & Christine Holly, owners <br />Proposal consists of a generator. Property is zoned B-One Family Residence. <br />The following variance is requested: <br />1. A 6 in. variance for side yard setback; code requires 5 ft., applicant shows 4 ft. 6 in., Section <br />1135.06(b). <br />Mr. Aspery said the applicant is proposing to install a two-foot by four-foot residential standby <br />generator to the west of their home. Code requires that the minimum side yard be five feet, the <br />proposed generator encroaches into the setback by six inches. The site plan does not clarify if the <br />generator will extend into the front yard, which is prohibited, and the decibel levels found in <br />Exhibit C, Page 3 exceed the allowable sound levels by receiving use stated in Chapter 555.04 of <br />the General Offenses Code. The sound level limit for residential land is 60 decibels, the <br />manufacturer specifications list the sound output at 66 decibels from 23 feet when operating at <br />normal operating load. The low-speed exercise mode output is 58 decibels from 23 feet, which <br />complies with this ordinance. This low-speed exercise mode is listed as a five-minute duration. <br />Mr. Holly said the generator will be between the ten-foot high hedge line and the house in the <br />side yard. The hedge line would help limit the noise and view of the generator. Ms. Holly added <br />that they will install fencing to shield it from view from the street. Ms. Holly has an in-home <br />baking business and needs the generator to protect her products in case of a power outage. They <br />often have guests who need electricity for medical reasons. The generator would be tested once a <br />week and can be run at any time as to limit disturbance to neighbors. The electrical box is <br />located in the basement near the proposed location of the generator. Mr. Holly did not think the <br />generator would affect the character of the neighborhood.
