CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />DECEMBER 1, 2005 <br />MINUTES <br />I. ROLL CALL: <br />Chairman Maloney called the meeting to order at 7:30 pm, <br />PRESENT: Chairman J. Maloney, T. Kelly, M. Diver and N <br />ALSO PRESENT: Assistant Law Director B. O'Malley, <br />Rymarczyk and Clerk of Commissions D. Rote. <br />ABSENT: Vice Chairman W. Kremzax <br />II. REVIEW AND CORRECTION OF MINUTES: <br />Sergi <br />Assistant Building Commissioner T. <br />M. Diver moved to approve the Board of Zoning Appeals minutes dated November 3, 2005 as <br />written. N. Sergi seconded the motion, which was unanimously approved. Chairman Maloney reviewed that there were 5 cases on the docket. He further advised that each <br />board member had viewed the premises involved for each case. Three votes are required for <br />approval and in addition, each case would be judged on the physical situation peculiar to itself, so <br />that in no way is a judgment rendered considered to be a general policy judgment affecting <br />properties and like situations elsewhere. <br />III. BUILDING DEPARTMENT REQUESTS: <br />OLD BUSINESS: <br />Mark McCollaugh; 23820 Lorain Road: (WRD # 2) <br />Request for variance (1123.12). The proposal consists of a storage shed. <br />The following variances are requested: <br />1). A 1,400 square foot variance for a storage building larger than code allows, (code permits 200 <br />sq ft, applicant shows 1,600 sq ft), section (1135.02 (D 1)). 2). A 1 foot 4 inch variance for an accessory structure higher than code allows, (code permits 12', <br />applicant shows 13' 4"), section (1135.02 (D3)). <br />Which is in violation of Ord. 90-125 sections (1135.02 (D1)) and (1135.02 (D3)). <br />Note: See Building Commissioners letter dated 10/26/05. <br />Chairman Maloney called for all interested parties to come forward at the start of the hearing and <br />again at the end of the hearing and Mr. McCollaugh was not present nor was there a representative <br />present for him. Mr..O'Malley advised that the board was not obliged to continue to table the issue <br />and the applicant was told he or a representative must be present. He advised the board that it was <br />within their right to address the request without the applicant table the matter or dismiss the matter. <br />J. Maloney motioned that as Mark McCollaugh of 23820 Lorain Road had failed to appear <br />twice the request is dismissed without prejudiced and the applicant is welcomed to reapply for <br />a variance if he wishes at a later date.
