OF ZOloTING APPEALS <br />HELD IN COUNCIL CHAlVIBE1tS <br />JUNE 1, 2006 <br />' MIlVUTES <br />ROLL CALL: <br />Chairman Maloney called the meeting to order at 7:40 pm. <br />PR]ESENT: Members; J. Maloney,lV. Sergi, T. Kelly, M. Diver and J. Burke. <br />AI.SO PRESEN'a": Law Director J. Dubelko, Building Commissioner D. Conway and Clerk of <br />Commissions D. Rote <br />Chairman Maloney reviewed that there were 9 cases requesting 11 variances and 1 speciai permit on <br />the docketo He fin-ther advised that each board member had viewed the premises involved for each <br />case. Three votes aze required for approval and in addition, each case would be judged on the <br />physical situation peculiar to itseif, so that in no way is a judgment readered considered to be a <br />general policy judgment affecting properties and like situations elsewhere. Furthermore due to a <br />miss-notification the first case (Gary Normand) would be rescheduled for the July meeting. <br />U. REVIEW AND CORRECTION OF MINUTES: <br />N. Sergi moved to approve the Board of Zoning Appeals minutes dated May 04, 2006, as <br />written. T. Kelly seconded the motion, which was unanimously approved. . <br />III. RESIDENTIAL APPEALS AND ItEQYJESTS: <br />1. Garv Nornaand; 6427 McKenzie ltoad: (WRD # 3) <br />Request for variance (1123.12). The proposal consists of a new garage. <br />The following variance is requested: <br />1. A 2,134 square foot varianee for combined gara.ge space total on a lot, (code pernaits 750 sq ft, <br />applicant shows 2,884 sq ft). <br />Which is in violation of Ord. 90-125 section; (1135.02 (c)). <br />Note: Total garage space includes exiting (22' x 22' (484 sq ft)) garage and proposed additional <br />garage (2,400 sq ft), plan shows a blacktop driveway to be constructed if approved. <br />2. Anthonv Caruso; 6591 Barton Road: (WRD #3) <br />Request for variance (1123.12). The proposal consists of a new shed <br />The following variances are requested: . <br />1. A 3 foot variance for storage shed higher than eode allows, (code permits 12', applicant shows <br />15'). Which is in violation of Ord. 90-125 section; (1135.02 (D 1)). <br />Mr. Caruso came forward to be swom in and address the request. Mr. Caruso advised that the 3- <br />foot height was to allow a loft in the shed. Mrs. Sergi questioned why a loft was requi.red and asked <br />if it was for a living or work room. Mr. Caruso advised he needed the stora.ge area and assured the <br />board that he would not use the loft as a living or work space. His land is 2.03 acres and he needs to <br />store his seasonal yazd equipment. Mrs. Diver advised that downspouts would be required on the <br />shed and the drainage swales would need to be maintained. <br />M. Diver moved to grant AnthQny Caruso of 6591 Barton Road his request for variance <br />(1123.12), which consists of a nevv shed and that the follow'vag variances is granted: <br />1.
