BOARD OF ZONING APPEALS <br />CITY OF NORTH OLMSTED <br />HEARING MINUTES OF SEPTEMBER 04, 2008 <br />ROLL CALL <br />Chairwoman Diver called the meeting to order at 7:30 pm in Council Chambers. <br />Present: Maureen Diver, Nancy Sergi, Laura Bellido, Jennifer Rudolph, Robert Menser arrived <br />at 8:40 pm. <br />Staff: Assistant Law Director Bryan O'Malley, Assistant Building Commissioner Dale <br />Mitchell, Clerlc of Commissions Donna Rote <br />Mrs. Diver advised all board members viewed each site and three votes were required for <br />approval. Each case is judged on the physical situation peculiar to itself, so that in no way is a <br />judgment rendered considered to be a general policy judgment affecting properties and like <br />situations elsewhere. Applicants were aslced to address all seven area variance standards noted. <br />REVIEW AND CORRECTION OF MINUTES <br />10'Is. Rudolph moved, seconded by Mrs. Bellido, to approve the August 07, 2008 Board of <br />Zoning Appeals minutes as written, whach was approved 4-0. <br />IVON-RESII)ENTIAL APPEALS AND 1ZEQUESTS: <br />COMS08-12: liTOAC (Saab, Mercedes, Porsche); 28545 Lorain Road: <br />Request for variance (1123.12). The proposal consists of building and parlcing renovations <br />• A special permit to add to a non-conforming building section (1165.02). <br />The following variances are requested: <br />1. A variance from section (1165.02) existing building is in violation of front setback. <br />2. An 18.9 foot variance for existing front building setback and new canopy code requires 75' <br />applicant shows 56.10', section 1139.07. <br />3. A 10 foot rear yard setbaclc variance for existing parking spaces code requires 15' applicant <br />shows 5', section 1139.07. <br />4. A variance for a second wall sign on both the Saab and Porsche buildings code permits 1 <br />applicant shows 2, section 1163.28. <br />5. A variance for 5 additional ground signs code permits 2 applicant shows 7, section 1163.27 A. <br />Note: Four ground signs were previously approved Saab requests 3 additional grounds signs. <br />6. A 125 foot variance for distance between southeast ground signs E& D code requires 200 ft, <br />applicant shows 75 ft, section 1163.27 A. <br />Prior to the opening of the case Mrs. Sergi excused herself from the discussions of the case and <br />Mrs. Diver advised the applicant of his rights pertaining to only three members addressing their <br />request and asked if they wish to proceed or wait for Mr. Menser to arrive. Mr. Broolcer chose to <br />proceed. Mr. Broolcer, Mr. Grady from Forum Architect and Mrs. Stephin a neighbor each came <br />forward to be sworn in and address the request. <br />Mr. Brooker said the special permit is required for the existing non-conforming building and the <br />new canopy which increases the already non-conforming setback. The variance from the code <br />section 1165.02 is for the canopy added. The 18.9' front setback variance is the new setback total. <br />The rear setback variance is for parking behind the Saab building which includes 7 new parking
