BOARD OF BUILDING CODE APFEALS <br />CITY OF NORTH OLMSTED <br />MINUTES OF MAY 21, 2009 <br />ROLL CAI,L <br />The meeting was called to at 5:45 p.m. in Council Chambers. <br />Present: Donna Sabo, Norman Althen, BJ Meder, Dan Jarachovic <br />Absent: Robert Lipcsey <br />Staff: Assistant Building Commissioner Dale Mitchell, Clerk of Commissions Donna Rote <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Jarachovic moved, seconded by Mr. Meder, to approve the Board of Building Code Appeals <br />minutes dated December 18, 2008 as written which was unanimously approved 4-0. <br />COMMUNICATIONS <br />Mr. Meder moved, seconded by Mr. Althen, to elect Donna Sabo as Chair, which was <br />unanimously approved 3-0. <br />Mr. Althen moved, seconded by Mrs. Sabo, to elect BJ Meder as Vice Chair, which was <br />unanimously approved 3-0. <br />• Building Deparhnent's 2008 Annual and 2009 Monthly Reports were received and briefly <br />reviewed noting the significant differences from one year to the next. <br />• Parallel fencing <br />Mrs. Sabo said the board wanted to discuss possible wording for addressing the fencing code <br />pertaining to parallel fencing when easements are involved. She provided board members copies <br />of other city's codes pertaining to fencing and noted none addressed easements. Mr. Jarachovic <br />said there is a redundancy with easements which should be allowed. <br />Mr. Mitchell said 1369.03 addresses parallel fences which is needed however there are <br />exceptions when there are utility easements which encompasses a 5 foot depth along each <br />neighbor's rear property lines. There is no way for either neighbor to connect the fencing as both <br />are required to remain outside the 5 foot easement. Regarding parallel fencing along a sideyard <br />the board could look at requiring a second fence being placed 5 foot inward from the property <br />line which is the standard sideyard setback. A 5 foot distance would allow the owner to maintain <br />the area between the fences. The maintenance of the area would be regulated under the cities <br />property maintenance codes. Mrs. Sabo questioned the building department's thoughts on split- <br />rail fencing. Mr. Mitchell said split-rail fencing is a fencing system as defined within the <br />building codes.
