BOARD OF ZONING APPEALS <br />CITY OF NORTH OLMSTED <br />MEETING MINUTES OF JUNE 4, 2009 <br />ROLL CALL <br />Mrs. Diver called the meeting to order at 7:30 pm in Council Chambers. <br />Present: Maureen Diver, Nancy Sergi, Laura Bellido, Jennifer Rudolph, Alfredo Lopez <br />Staff: Assistant Law Director Bryan O'Malley, Assistant Building Commissioner Dale <br />Mitchell, Clerk of Commissions Donna Rote <br />REVIEW AND CORRECTION OF MINUTES <br />Ms. Rudolph moved, seconded by Mrs. Sergi, to approve the May 7, 2009 Board of Zoning <br />Appeals minutes which were unanimously, approved 5-0. <br />RESIDENTIAL APPEALS AND REQUESTS: <br />Larrv & Patricia Yelco; 5582 Burns Road: <br />Request for variance (1123.12). Proposal consists of a new detached garage; the following <br />variances are requested: <br />1. A 2 foot sideyard setback variance for detached garage; code requires 5', applicant shows 3' <br />2. A 7 foot rear yard setback for detached garage; code requires 10', applicant shows 3'. <br />Proposal is in violation of Ord. 90-125 section 1135.02 (C)(2). <br />Mr. Yelco and Mr. D'Amico with Great Garage Company were sworn in. Mr. D'Amico said the <br />request is for a 20' x 20' detached garage. If the garage is placed to code it would place it in <br />such a manner that access to the garage would be very limited. Granting the variances would <br />allow the owner to reuse the existing concrete slab and provide reasonable access to the garage. <br />The size of the lot is such that moving the garage would eliminate what little greenspace there is <br />on the lot. The garage sideyard will be in one foot from the existing garage to meet door <br />placement codes. Mr. Mitchell noted that the aerial view of the lot showed that five abutting <br />homes had similar placements due to lot size therefore he had no obj ections to the request. The <br />owner is not enlarging the garage and using the existing footprint. Mrs. Sergi said that this <br />would be the time to bring the garage into code, but the size of the lot limits the placement <br />therefore she did not object. Mr. Lopez said due to lot size and reusing existing footprint he had <br />no objections. Ms. Rudolph believed that there was no other way to place the garage on the lot. <br />Mrs. Bellido and Mrs. Diver agreed with these comments. <br />Ms. Rudolph moved, seconded by Mrs. Sergi, to grant Larry & Patricia Yelco of 5582 <br />Burns Road the following variances for a new detached garage: 1. A 2 foot side yard <br />setback variance for detached garage; code requires 51, applicant shows 3'. 2. A 7 foot rear <br />yard setback for detached garage; code requires 101, applicant shows 31. Proposal is in <br />violation of 90-125 section 1135.02 (C)(2). The motion was unanimously approved 5-0.
