<br />"TOGETHER WE CAN MAKE A DIFFERENCE!" <br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />MINUTES - MAY 7, 1998 - 7:30 P.M. <br />I. ROLL CALL: <br />Chairman Gomersall called the meeting to order at 7:40 p.m. <br />PRESENT: Chairma.n R. Gomersall, Commissioner J. Konold, Commissioner T. Koberna, <br />Commissioner W. Kremzar Jr., and Commissioner J. Maloney. <br />ALSO PRESENT: Law Director Gareau Assistant Building Commissioner Rymarczyk, <br />and Assistant Clerk of Commissions Rote. <br />II. DISPOSITION OF MINUTES: J. Konold moved to approve the March 26, 1998 minutes. <br />The motion was seconded by, T. Koberna. Roll call on motion: R. Gomersall (yes), <br />J. Konold (yes), T. Koberna (y) W. Kremzar (y) and J. Molony (abstained). Motion carried. <br />kChairman Gomersall advised that each case would be judged on the physical situation peculiar to <br />itsel? so that in no way is a judgment rendered considered to be a general policy judgment <br />affecting properties and like situations elsewhere. ' <br />Mr. Gomersall called a 5 minute recess for an executive session. Mr. Gareau stated the purpose <br />of the executive session is to discuss with the board members the current agreed order in the case <br />of the North Olmsted chamber of commerce verses City of North Olmsted the board has got to <br />be informed with respect to this pending litigation. Dunking Donuts, 26963 Lorain Road: <br />Request Special permit (1123.11)Request a special permit to add to a non-conforming <br />bu.ild.ing. Special permit required Ord. 90-125, Section 1165.02. Request for. variance <br />(1123.12). <br />Request the following variances for the expansion ofnon-conforming building: <br />1) a 7 foot side yard setback variance (10 feet is required 1165.02); and <br />2) a 38 foot variance for front yard setback (75 feet required 1139.07) <br />Also request the following signage variances: <br />3) a variance to place a grou.ud sign in the 35 foot triangle (1163.12-B); 4) an 8'6" setback variance for the directional signs (1163.12-E); and <br />Note: They are now only 1 foot 6 inch.from the right of way and are requ.ired to be 10 feet. <br />-5) a variance to have two coiporate names on the free standing sign, where as the code <br />permits only one for a business building (l 1b3.12-H). Violation of Ord. 90-125, Secrion(s) 1165.02, 1139.07, 1163.12-B, 1163.12-E, and 1163.12- <br />H. Note: Heard by plauning commission 04/14/98 and by architectural review board <br />04/22/98. <br />Chairman Gomersall called all interested parties before the board. The oath was administered <br />to Allen Bornstein, and Michael Yasenchack. Mr. Bomstein presented the proposal for <br />Dunkin Donuts, the build.ing is a.n existing Dunkin Donuts bu.ilding, which will be converted <br />into a combination store of Baskin & Robins / Duvkin Donuts that will call for a customer <br />addition which will be in the front of the building, and a new walk-in addition on the East side <br />of the building. we will also be incorporating landscaping suggestions that the Architectural <br />review board has made.
