.. <br />; <br />CITY OF NORTH OLMSTED <br />"TOGETHER WE CAN MAKE A DIFFERENCE!" <br />BOARD OF ZONING APPEALS <br />CORRECTED MINUTES: MINiITES - MARCH 5,1998 <br />7:30 P.M. <br />Chairman Gomersall called the meeting to order at 7:40 P.M. Present: R. Gomersall, J. Konold, J. Maloney, and T. Koberna <br />Also Present: Law Director Gareau, Building commissioner Conway, Clerk of Commissions Comish, and Assistant <br />Clerk of Commissions Rote. <br />J. Konold moved to approve the February 11, 1998 minutes, seconded by J. Maloney and Gomersall abstained all else <br />yes. <br />Chairman Gomersall advised that each case would be judged on the physical situation peculiar to itself, so that in no <br />way is a judgment rendered considered to be a general policy judgment affecting properties and like situations <br />elsewhere. Three votes are required for approval. Building pernuts for all variances or special permits granted may be <br />picked up Monday at the building department. <br />Sunnvside Toyota, 26890 Lorain Road <br />Applicant requests tabling the Sunnyside Toyota sign proposal until the March 26, 1998 meeting. <br />R Gomersall moved to grant Sunnyside Toyota, 26890 Lorain Road, their request to table the proposal until the <br />March 26, 1998 mceting. The motion was seconded by J. Maloney and unanimously approved. Request to table <br />proposal granted. <br />2. Frank Valencic, 29650 7osephine Drive <br />Request for variance (1123.12). Request the following variances to construct addition: an 8 foot, 1 inch rear <br />setback variance and a 27 square foot variance for lot coverage in excess of 25% of the rear yard area. <br />Violation of Ord. 90-125, Section(s) 1135.06 and 1135.05 (C). ; <br />Chairman Gomersall called all interesterl parties before the board. The oath was administered to Mr. Valencic. <br />Mr. Gomersall read Mr. Valencic's request and stated that it was quite clear as to what Mr. Valencic was <br />requesting, the members had no problem with this request. <br />J. Konold moved to grant Mr. Valencic, 29650 Josephine Drive., a 8 foot 1 inch rear setback variance, a 27 <br />square foot variance for lot coverage in excess of 25% of the rear yard area. Violation of Ord. 90-125, Section(s) <br />1135.06 and 1135.05 (C). The motion was seconded by T. Kobema and unanimously approved. Variance <br />granted. <br />3. Ronald Soltosz. 5975 Decker Road " <br />Request for variance (1123.12). Request a 42 square foot variance for existing shed, which exceeds 2% <br />of the rear yard area. Violation of Ord. 90-125, Section 1135.02 (d-1) <br />Chairman Gomersall calletl all interested parties before the board. The oath was administered to Mr.Soltosz. Mr. <br />Gomersall asked Mr. Soltosz if he acquired a pernut before he put the shed up. Mr. Soltosz stated that fie hired <br />Heartland Coiporation of America and they were to take care of any pernuts needed, one month prior to that he <br />had 7 8c R Fence campany of Ohio install a fence and on the last inspection of the fence the inspector noticed that <br />the shed had been built and no pernut was on file and corrtacted him. Mr. Soltosz called the inspector and was <br />told that he would nced to come before the board to get a variance. Mr. Gomersall stated in the future check with <br />' the building department if there is ever a question. Mr. Kobema requested a side note.about it being the third time <br />that Heartland Corporation of America,did work without a pernut and that the building department should send
