ROLL CALL: <br />Chairman, Tallon called the meeting to order at: 7:30pm <br />PRESENT: Chairman, R. Tallon, Commissioners, W. Spalding, S. Asseff, R. Koeth, T. Brennan, <br />and K. O'Rourke. <br />ALSO PRESENT: Assistant Law Director, J. Dubelko, Engineering Commissioner, P. <br />Deichmann, Building Commissioner, D. Conway, and Clerk of Commissions, D. Rote. <br />II. REVIEW AND CORRECTION OF NIlNUTES: The minutes of April 13, 1999, Planning <br />Commission meeting were submitted for approval. <br />R. Tallon motioned to approve the April 13, 1999, Planning Commission minutes as written. The <br />motion was seconded by K. O'Rourke and unanimously approved. <br />III. BUII_,DING DEPARTMENT REQUESTS: <br />1. Crete Plaza Phase 1& 2: 24361 Lorain Road: <br />Proposal consists of an application for a conditional use permit. <br />Note; the Planning Commission on 4/8/97 & 5/13/97, and the Architectural Review Board <br />4/16/97 & 5/21/97 heard this case. <br />Chairman Tallon called all interested parties forward and reviewed the proposal. Mr. Mongello, <br />and Ms. Kopko, from Mongello & Associates, Mr. Potz, the owner, and Ms. Marinescu, the <br />tenant canne forward to present their proposal. Mr. Potz, suggested Ms. Marinescu would like to <br />seek a conditional use permit to run a daycare center. Mr. Mongello indicated Mr. Conway <br />instructed-him that the plan would have to go before the Planning Commission and then on to <br />Council for a conditional use permit. The building is located southwest of fire station 1. The <br />building is behind the phase 2 building that is presently being built. The hours of operation are <br />Monday through Friday from 6:00am to 6:00pm. NIr. Tallon questioned were the playground <br />would be located. Ms. Kopko indicated the playground would be a fenced in area behind the <br />center. Mrs. O'Rourke asked how many children would be in the building. She also questioned <br />what the front building would be used for. Mr. Mongello suggested the owner contracted a <br />woman's clinic and he is not sure about the rest of the building. Mrs. O'Rourke indicated she was <br />concerned about the amount of traffic that would be generated at the two sites. Mr. Koeth asked <br />Mr. Dubelko about ordinance 1139, which indicates that serving liquor could not be sold within <br />500 feet from a school, playground, or childcare. He asked if Mr. Potz being limited as to what <br />tenants could be located in the front building. Mr. Dubelko indicated there had been an earlier <br />ruling by Mr. Gareau when the VFW post was proposed for this building. He indicated Mr. <br />Gareau ruled that the state of Ohio grants licenses for location for liquor to be sold. The City can <br />not use its zoning powers to interfere with the location or the granting of a liquor license. He <br />indicated whether or not this case is granted their permit or not, a tenant at the shopping center <br />could apply with the State of Ohio for a liquor license. The City would have the opportunity to <br />object to it because the City would be notified, but the State would have the final say. Mr. <br />1
