A <br />CITY OF NORTH OLMSTED <br />"TOGETHER WE CAN MAKE A DIFFERENCE" <br />BOARD OF ZONING APPEALS <br />MINUTES - SEPTEMBER 7, 2000 <br />ROLL CALL: ' <br />Chairman, Maloney called the meeting to order at 7:30pm. <br />PRESENT: Chairman, J. Maloney, Board Members, J. Konold, T. Koberna and W. Kremzar. <br />ALSO PRESENT: Law Director, M. Gareau, Asst. Building Commissioner, T. Rymarczyk, Clerk of <br />Commissions, D. Rote and Asst. Clerk of Commissions, S. Solomon. <br />II. REVIEW AND CORRECTION OF MINUTES: The Board of Zoning and Appeals minutes of <br />August3, 2000 have been submitted for review. <br />Chairman Maloney questioned if the board had corrections or additions to the minutes of the August <br />3, 2000 minutes. Mr. Kremzar reviewed the following corrections; (3). should be 50 and 41 feet not <br />50 and 41 inches, (4). Should be 50 feet, not 50 inches, arid part two of (4). Should reflect 50 feet. <br />W. Kxemzar motioned to approve the Board of Zoning Appeals minutes dated August 3, 2000 as <br />amended. The motion was seconded by J. Konold and unanimously approved. . <br />Chairman, Maloney advised that each case would be judged on the physical situation peculiar to itself, <br />so that in no way is a judgment rendered considered to be a general policy judgment affecting <br />properties and like situations elsewhere. He explained that it would take three affirmative votes to <br />approve a request. All permits and or variances granted may be picked up Wednesday in the building <br />department. <br />III. BUII.,DING DEPARTMENT REQUESTS: <br />David W. 1Vliller; 24908 Antler Dr. <br />Request for variance (1123.12). The proposal consists of a shed. <br />The following variances are requested: <br />1) A 7 foot variance for rear yard setback (code requires 10 ft, applicant shows 3 ft) section <br />(113 5.02 (D) (4)). <br />2) A 54 square feet variance for the size of a shed (lot coverage exceeds 2%) (code pernuts 66 <br />sq. ft, applicant shows 120 sq. ft), section (1135.02 (D) (1)). Note: Shed was previously <br />constructed without a permit. <br />Which is in violation of Ord. 90-125 section, .1135.02 D l, and 1135.02 D 4. <br />Chairman, Maloney called all interested parties forward and reviewed the request. The oath was <br />administered to Mr. Miller who came forward to review the request. Mr. Miller commented that <br />he was not aware that he needed a pernut to build a shed. He purchased a shed and built it in the <br />same location of his yard as several other properties along his street have done. He did not know <br />there was a requirement for the shed to be 10 feet off his property line. Since it was inside his <br />property line he thought it was fine. He also didn't know that he needed a variance for the size of <br />the barn compared to the size of the yard. As soon as he found out he applied for the pernut and <br />the Building Department told him he needed a variance. Mr. Miller submitted letters from his <br />neighbors stating they all approved of the shed. At this time, he also presented pictures of the <br />shed to the Commission. Mr. Kremzar questioned why he only went 3 feet off the rear lot line <br />instead of 5 feet. Mr. Miller replied that he has dogs and. he brought it off the property line so he <br />can get behind the shed in case anyone needs to get to the power lines, or if he was going to put
