r CITY OF NORTH OLMSTED <br />"TOGETHEIa WE CELN MAKE A DIFFERENCE" <br />BOARD OF ZONING APPEALS <br />MINUTES - AUGUST 3, 2000 <br />I. ROLL CALL: <br />Vice Chairman,lVlaloney called the meeting to order at 7:30pm. <br />PRESENT: Vice Chairman, J. Maloney, Board Members, J. Konold, T. Koberna and W. Kremzar. <br />ALSO PRESENT: Law Director, M. Gareau, Building Commissioner, D. Conway, Clerk of <br />Commissions, D. Rote and Asst. Clerk of Commissions, S. Solomon. <br />Vice Chairman Maloney announced that the North Olmsted, Board of Zoning Appeals Chairman, Mr. <br />Robert Gomersall passed away on Sunday, 7uly 30, 2000. Chairman, Gomersall served the City of <br />North Olmsted and this board from 1985, as a board member, to 1989 at which time he was elected <br />Chairman. Mr. Gomersall served as Chairman of the Board of Zoning Appeals from 1989 until his <br />passing which was 11 years. At this time, the board would like everyone to stand for a moment of <br />silence for your own prayers or reflection, in memory of this wonderful civil servant that gave so <br />freely of himself to the community of North Olmsted. <br />II. REVT-EW AND CORRECTION OF NIINiJTES: The Board of Zoning and Appeals minutes of July <br />6, 2000 have been submitted for review. <br />J. Konold motioned to approve the Board of Zoning Appeals minutes dated July 6, 2000. The <br />motion was seconded by T. Koberna and unanimously approved. Vice Chairman, Maloney advised that each case would be judged on the physical situation peculiar to <br />itself, so that in no way is a judgment rendered considered to be a general policy judgment affecting <br />properties and like situations elsewhere. He explained that it would take three affirmative votes to <br />approve a request. All permits and or variances granted may be picked up Wednesday in the building <br />department. <br />1. John Horsfall: 5760 Canterburv Road: <br />Request for variance (1123.12). The proposal consists of an addition to the existing home. <br />The following variances are requested: <br />A special permit to add to a non-conforming building, section (1165.02). <br />1. A 7 foot variance for rear yard setback, (code requires Soft, applicant shows 43ft), section <br />(1135.08 A). " <br />2. A 1 foot variance for distance between dwelling and detached garage, ( code requires 15ft, <br />applicant shows 14ft), section (1135.02 C-Z). <br />Which is in violation of Ord. 90-125 sections, (1135.08 A), (1135.02) and 1165.02). <br />Note: Addition effectively makes the garage a one car parking space. <br />Vice Chairman, Maloney called all interested parties forward and reviewed the request. The <br />oath was administered to Mr. Horsfall, the owner, and Mr. Horsfall Jr., each of whom came <br />forward to review the request. Mr. Horsfall indicated that the reason they would be out that <br />far was to accommodate a stairwell for a second floor. They would like to make the rooms a <br />decent size. Mr. Horsfall Jr. indicated that they were anticipating a larger family in the future <br />and they would need the additional room. We are taking it to the rear because of the tree in <br />the front. Mr. Maloney questioned if the addition would have a firewall. Mr. Horsfall <br />commented that the interior of the garage would be finished.
