ROLL CALL: <br />CITY OF NORTH OLIVISTEI) <br />"TOGETHER WE CAN MAKE A DIFFERENCE" <br />BOARI) OF ZONING APPEALS <br />MINLTTES - APIdIL 6, 2000 <br />Chairman Gomersall called the meeting to order at 7:30pm. <br />PRESENT: Chairman R. Gomersall and Board Members J. Maloney, W. Kremzar, J. Konold. <br />ALSO PRESENT: Asst. Building Commissioner T. Rymarczyk, and Asst. Clerk of Commissions <br />K. Fallon. <br />ABSENT: Board Member T. Koberna and Law Director M. Gareau. <br />Chairman Gomersall advised that each case would be judged on the physical situation peculiar to <br />itself, so that in no way is a judgment rendered considered to be a general policy judgment affecting <br />` properties and like situations elsewhere. <br />II. REVIEW AND CORRECTION OF MINUTES: The Board of Zoning and Appeals minutes of <br />February 3, 2000 and March 2, 2000 have been submitted for review. <br />J. Konold motioned to approve the minutes of February 3, 2000 and March 2, 2000 as submitted. <br />The motion was seconded by W. Kremzar and unanirnously approved. <br />III. BUILDING DEPARTMENT REQUESTS: <br />1. Brvant Hundt of 5716 Forest Ridge Park: <br />Request for variance (1123.12). Proposal consists of an addition to the family room. <br />The following variance is requested: <br />A 7 foot variance for rear yard setback, (code requires 50 feet, applicant shows 43 feet). <br />Which is in violation of Ord. 90-125 section 1135.08A. <br />Chairman Gomersall called all interested parties forward to review the request. James Muraco, Mr. <br />Hundt's brother-in-law, came forward to review the request. Mr. Gomersal] questioned if there <br />were any questions from the board or audience members. No further comments were made. <br />J. Konold motioned to grant Bryant Hundt of 5716 Forest Ridge Park his request for variance <br />(1123.12), wluch consists of an addition to the family room and that the following variance is <br />granted: A 7 foot variance for rear yard setback, (code requires 50 feet, applicant shows 43 feet). <br />Which is in violation of Ord. 90-125 section 1135.08A. The motion was seconded by W. Kremzar <br />and unanimously approved. Vaxiance Granted. <br />2. Mark Banak3386 E. Oxford Oval Request for variance 1123.12. The proposal consists of a shed. <br />The following variances are request: <br />1.) An 8 foot variance for rear setback (code requires 10 feet, applicant shows 2 feet), <br />(1135.02 d 4). <br />2.) A 55 foot variance for exceeding allowable square footage (code requires .25 square foot, <br />applicant shows 80 square foot), (1135.02 d 1). <br />Which is in violation of Ord. 90-125 sectioris 1135.02(d)(4) and 1135.02(d)(1). <br />Chairman Gomersall called all interested parties forward to review the request. Mark Banak came <br />forward to review his request. Mr. Gomersall indicated he had a hard time figuring out a drawing. <br />Mr. Banak indicated an 8-foot variance is needed to build an 8-foot by 10 foot shed. According to <br />the Code, the shed would need to be 10-feet from the back property line. Mr. Gomersall questioned <br />that Mr. Bana.k wanted the shed 2 feet from the rear property line, and he believes this is too close.
