ROLL CALL: <br />Chairman, Maloney called the meeting to order at 7:30 p.m. <br />PRESENT: Chairman, J. Maloney, Board members, J. Konold, T. Koberna and T. Kelly. <br />ALSO PRESENT: Law , I)irector, M. Gareau, Asst. Building Commissioner, T. Rymarczyk and Clerk of <br />Commissions, D. Rote. <br />ABSENT: Board member; W. Kremzar. " <br />II, REVIEW AND CORRECTION OF MINUTES: The Board of Zoning Appeals minutes of November l, <br />2001 have been submitted for approval. <br />J. Konold motioned to approve the Board of Zoning Appeals minutes dated November 1, 2001 as written. <br />The motion was seconded by T. Koberna and was unanimously approved. Approved. <br />Chairman Maloney indicated that there were nine (9) cases requesting eighteen (18) variances and two <br />special permits. He also announced that Great Northern Mall, which was the tenth proposal on the <br />docket, withdrew their request. The chairman further advised that each board member had viewed the <br />premises involved for each case. Three votes are required for approval. In addition each case will be <br />judged on the physical situation peculiar to itself, so that in no way is a judgment rendered considered to <br />be a general policy judgment affecting properties and like situations elsewhere. <br />BUILI3ING DEPARTMENT REQIJESTS: <br />1) Ga1e Sipe24455 Beech Ln. <br />Request for variance (1123.12). The proposal consists of adding a roof over the front stoop. The <br />following variances are requested: <br />A special permit to add to a non-conforming building (1165.02). <br />1) A 5 ft. variance for required front yard setback (code requires 50 ft., applicant shows 45 ft.). <br />Which is in violation of Ord. 90-125 section, 1165.02 and 1135.06. <br />Chairman Maloney called all interested parties forward to review the request. Ms. Sipe; the owner came <br />forward to be sworn in and review her request. 1VIs. Sipe indicated that she would like to have a stoop <br />over the entrance to her home. The stoop is needed to protect visitors from the weather. <br />J. Konold motioned to grant Ga1e Sipe of 24455 Beech Lane her request for variance (1123.12) which <br />consists of adding a roof over front stoop and that the following variances be granted: <br />A special permit to add to a non-conforming building (1165.02). <br />1) A 5 ft. variance for required front yard setback (code requires 50 ft., applicant shows 45 ft.). The following variances are <br />requested: <br />1) A 350 sq. ft. variance for a detached garage (code permits 750 sq. ft., applicant shows 1,100 sq. ft.), <br />section (1135.02, C, 3). <br />2) A driveway variance for hard surface drive to new garage (code requires hard surface, applicant show <br />slag), section (1161.11 A).
