ROLL CALL: <br />Chairman, Maloney called the meeting to order at 7:30 p.m. <br />PRESENT: Chairman, J. Maloney, Board members, W. Kremzar and T. Kelly. <br />ABSENT: Board members, T. Koberna and J. Konold. <br />ALSO PRESENT: Law Director, M. Gareau, Building Commissioner, D. Conway and Asst. Clerk of <br />Commissions, S. Solomon. <br />II. REVIEW AND CORRECTION OF MINUTES: The Board of Zoning Appeals minutes of August 2, <br />2001 been submitted for approval. <br />W. Kremzar motioned to approve the Board of Zoning Appeals minutes dated August 2, 2001 as written. <br />The motion was seconded by T. Kelly and was unanimously approved. Approved 9/6/01. <br />J. Maloney advised that each board member had viewed the premises involved for each case. Three votes <br />are required for approval. In addition each case will be judged on the physical situation peculiar to itself, <br />so that in no way is a judgment rendered considered to be a general policy judgment affecting properties <br />and like situations elsewhere. As there are only three board members present and it takes three <br />affirmative votes to approve a request, applicant's may table themselves until the next meeting. <br />I BUILDING DEPARTMENT REQUESTS: <br />1. James McFarland; 5542Revere Dr. <br />Request for variance (1123.12). The proposal consists of an oversized shed. . <br />The following variance is requested: <br />A 21 sq. ft. variance for oversized shed (code permits 99 sq. ft., applicant shows 120 sq. ft.), section <br />1135.02 D-1). <br />Which is in violation of Ord. 90-125 section, 1135.02 D-l. <br />Chairman Maloney called all interested parties forward to review the request. The oath was administered <br />to James IVIcFarland, the owner, who came forward to review the request. Mr. Maloney indicated that <br />Mr. McFarland was here before for this shed and now he wants a 21 sq. ft. variance because he is putting <br />in a larger shed. Mr. 1VIcFarland replied that he should have done his homework and he would have <br />applied for this variance when he applied for the setback variance. The board had no problems. Mr. <br />Maloney called for a motion. <br />W. Kremzar motioned to grant James McFarland of 5542 Revere Dr. his request for variance 1123.12. <br />Which consists of an oversized shed and that the following variance be granted: <br />A 21 sq. ft. variance for oversized shed (code permits 99 sq. ft., applicant shows 120 sq. ft.), section <br />1135.02 D-1). Which is in violation of Ord. 90-125 section, 1135.02 D-l. The motion was seconded by <br />T. Kelly and unanimously approved.
