ROLL CALL: <br />Chairman, Maloney called the meetino, to order at 7:30 p.m. <br />PRESENT: Chairman, J. Maloney, Board members, T. Koberna, J. Konold, W. Kremzar and T. Kelly. <br />ALSO PRESENT Law Director, M. Gareau, Building Commissioner, D. Conway and Asst. Clerk of <br />Commissions, S. Solomon. <br />II. REVIEW AND CORRECTION OF MINUTES: The Board of Zoning Appeals minutes of June 7, 2001 <br />and July 5, 2001 have been submitted for approval. <br />J. Konold motioned to approve the June 7, 2001 Board of Zoning Appeals minutes as written. The <br />motion was seconded by W. Kremzar and unanimously approved. Approved 8/3/01. <br />W. Kremzar motioned to approve the July 5, 2001 Board of Zoning Appeals minutes as written. The <br />motion was seconded by T. Koberna and unanimously approved. Approved 8/3/01. <br />J. Maloney advised that each board member had viewed the premises involved for each case. Three votes <br />are required for approval. In addition each case will be judged on the physical situation peculiar to itself, <br />so that in no way is a judgment rendered considered to be a general policy judgment affecting properties <br />and tike situations elsewhere. <br />ITI. BLTII,DING DEPARTMENT REQLTESTS: <br />l. Robert Erich; 4741 Baile jj Rd. <br />Request for variance (1123.12). The proposal consists of replacing a detached garage. The following <br />variances are requested: <br />1) A 5 ft. variance for required rear yard setback (code reQuires 10 ft., applicant shows 5 ft.), section <br />(1135.02 C-2). <br />2) A 32 sq. ft. variance for exceeding allowable 20% of rear yard (code permits 640 sq. ft., applicant <br />shows 672 sq. ft.), section (1135.02 D-2). <br />Which is in violation of Ord. 90-125 section, 1135.02 C-2 and 1135.02 D-2. <br />Chairman Maloney called al] interested parties forward to review the request. The oath was administered <br />to Robert \Erich, the owner, and John Montean, a neighbor from 4731 Bailey Rd., who came forward to <br />review the request. Mr. Erich indicated that he wants to put the new garage in the same place as the one <br />he will be tearing down. The new garage will be 5 ft. wider. Mr. Konold questioned if he would still <br />maintain his 5 feet. Mr. Erich replied yes, he would. The board had no further comments. Mr. Maloney <br />called for a motion. <br />J. Konold motioned to grant Robert Erich of 4741 Bailey Rd. his request for variance (1123.12).
