CITY OF NORTH OLMSTED "TOGETHER WE CAN MAI?E A DIFFERENCE" BOARD OF ZONING APPEALS MINUTES - JUNE 6, 2002 7:30 P.M. I. ROLL CALL: Vice Chairman, W. Kremzar called the meeting to order at 7:40 p.m. PRESENT: Vice Chairman, W. Kremzar, and Board members, T. Kelly, and N. Sergi ABSENT: Chairman, J. Maloney, and Board member J. Konold- ALSO PRESENT: Assistant Law Director, B. O'Malley, Building Commissioner, D. Conway and Asst. Clerk of Commissions, A. Kilbane. II. REVIEW AND CORRECTION OF MIlNUTES: The Board of Zoning Appeals minutes of May 2, 2002 have been submitted for review: _ T. Kelly motioned fo approve the minutes as submitt ed. The motion was seconded by N. Sergi and unanimously approved. Vice Chairman Kremzar indicated that there are 18 cases requesting 32 variances and 2 special permits. Mr. Kremzar pointed out that request number 5 on the agenda has been tabled at the applicant's :request. It will be.heard at the July meeting. He then informed those in attendance that each board member had viewed the premises involved for each case. Three votes are required for approval. He pointed out that orily three members were present. He indicated that applicants have the choice to table their request until the next full meeting. He asked that applicants advise the board if they wish to withdraw at this time. A gentleman from the audience asked if it is possible to reapply if a variance 'is denied. Mr. Kremzar indicated there would have to be a change to the variance request. Mr. Conway said the request would have to be reduced by 25%. The representative from North Olmsted Collision (request #15) asked to be tabled until a later date. Mr. Kremzar asked the applicant to provide additional information on the dimensions before the next meeting. He continued and indicated each case will be judged on the physical situation peculiar to itself, so that in no way is a judgment rendered considered to be a general policy judgment affecting properties and like situations elsewhere. III. BUII.,DING DEPARTMENT REQUESTS: 1). Maureen Loeser; 4673 Williamstown Dr.; (WRD 1) Request for variance (1123.12). The proposal consists of installing a swimming pool in a side yard. The following variance •is requested: 1. An 11 foot variance for swimming pool in side yard (code requires 25 ft., applicant shows 14 ft.). Which is in violation of Ord. 90-125 section (1135.02 (i)). - Vice Chairrilan Kremzar called all interested parties forward to review the request. Mrs. Loeser came forward to be sworn in. Mr. Kremzar pointed out there is an amendment to the request and he read the proposal. N. Sergi motioned to grant Maureen Loeser, 4673 Williamstown Dr., her request for variance (1123.12), which consists of installing a swimming pool in a side yard and that the following variance be granted: 1. An 11 foot variance for swimming pool in side yard (code requires 25 ft., applicant shows 14 ft.). Which is in violation of Ord. 90-125 section (1135.02 (i)). The motion was seconded by W. Kremzar and unanimously approved. Variance Granted.
