CITY OF NORTH OLMSTED <br />"TOGETHER WE CAN MAI?E A DIFFERENCE" <br />BOARD OF ZONING APPEALS <br />MINUTES - JUNE 6, 2002 <br />7:30 P.M. <br />I. ROLL CALL: Vice Chairman, W. Kremzar called the meeting to order at 7:40 p.m. <br />PRESENT: Vice Chairman, W. Kremzar, and Board members, T. Kelly, and N. Sergi <br />ABSENT: Chairman, J. Maloney, and Board member J. Konold- <br />ALSO PRESENT: Assistant Law Director, B. O'Malley, Building Commissioner, D. Conway and <br />Asst. Clerk of Commissions, A. Kilbane. <br />II. REVIEW AND CORRECTION OF MIlNUTES: The Board of Zoning Appeals minutes of May 2, <br />2002 have been submitted for review: _ <br />T. Kelly motioned fo approve the minutes as submitt ed. The motion was seconded by N. Sergi and <br />unanimously approved. <br />Vice Chairman Kremzar indicated that there are 18 cases requesting 32 variances and 2 special <br />permits. Mr. Kremzar pointed out that request number 5 on the agenda has been tabled at the <br />applicant's :request. It will be.heard at the July meeting. He then informed those in attendance that <br />each board member had viewed the premises involved for each case. Three votes are required for <br />approval. He pointed out that orily three members were present. He indicated that applicants have the <br />choice to table their request until the next full meeting. He asked that applicants advise the board if <br />they wish to withdraw at this time. A gentleman from the audience asked if it is possible to reapply if <br />a variance 'is denied. Mr. Kremzar indicated there would have to be a change to the variance request. <br />Mr. Conway said the request would have to be reduced by 25%. The representative from North <br />Olmsted Collision (request #15) asked to be tabled until a later date. Mr. Kremzar asked the applicant <br />to provide additional information on the dimensions before the next meeting. He continued and <br />indicated each case will be judged on the physical situation peculiar to itself, so that in no way is a <br />judgment rendered considered to be a general policy judgment affecting properties and like situations <br />elsewhere. <br />III. BUII.,DING DEPARTMENT REQUESTS: <br />1). Maureen Loeser; 4673 Williamstown Dr.; (WRD 1) <br />Request for variance (1123.12). The proposal consists of installing a swimming pool in a side yard. <br />The following variance •is requested: <br />1. An 11 foot variance for swimming pool in side yard (code requires 25 ft., applicant shows 14 ft.). <br />Which is in violation of Ord. 90-125 section (1135.02 (i)). - <br />Vice Chairrilan Kremzar called all interested parties forward to review the request. Mrs. Loeser came <br />forward to be sworn in. Mr. Kremzar pointed out there is an amendment to the request and he read the <br />proposal. <br />N. Sergi motioned to grant Maureen Loeser, 4673 Williamstown Dr., her request for variance <br />(1123.12), which consists of installing a swimming pool in a side yard and that the following variance <br />be granted: <br />1. An 11 foot variance for swimming pool in side yard (code requires 25 ft., applicant shows 14 ft.). <br />Which is in violation of Ord. 90-125 section (1135.02 (i)). The motion was seconded by W. Kremzar <br />and unanimously approved. Variance Granted.
