CITY OF NORTH OLMSTED <br />"TOGETHER WE CAN MAKE A DIFFERENCE" <br />BOARD OF ZONING APPEALS <br />MINUTES - DECEMBER 5, 2002 <br />COUNCIL CHAMBERS <br />1. ROLL CALL: Chairman Maloney called the meeting to order at 7:35 p.m. <br />PRESENT: Chairman J. Maloney, Board members W. Kremzar, J. Konold and N. Sergi. <br />ALSO PRESENT: Assistant Law Director B. O'Malley, Building Commissioner D. Conway, and <br />Assistant Clerk of Commissions A. Kilbane. <br />ABSENT: Board member T. Kelly <br />II. REVIEW AND CORRECTION OF NIlNUTES: <br />The Board of Zoning Appeals minutes of November 7, 2002 have been submitted for approval. <br />J. Konold inade a motion to approve the minutes as submitted. The motion was seconded by W. <br />Kremzar and unanimously approved.. <br />Chairman Maloney indicated there are 7 cases requesting 31 variances and 1 special permit. The <br />Chairman advised that the board members have viewed the premises involved for each case. Three <br />votes are required for approval. In addition each case will be judged on the physical situation peculiar <br />to itself, so that in no way is a judgment rendered considered to be a general policy judgment affecting <br />properties and like situations elsewhere. <br />III. BUII_,DING DEPARTMENT REQUESTS: <br />1). Marv Frances Ink; 23044 Marion Road: WRD 2 <br />Request for variance (1123.12). The proposal consists of a new detached garage. <br />The following variance is requested: <br />l. A 5 foot variance for a detached garage too close to a residence (code requires 15 ft., applicant <br />shows 10 ft.). <br />Which is in violation of Ord. 90-125, section (1135.02 (c)(2)). <br />Chairman Maloney called all interested parties forward to review the request. Miss Ink came forward <br />and was sworn in. She then explained she wants a larger garage. It would be closer to her house <br />which is why she needs a variance. In the future, 2-3 years from now, she may connect it to her house <br />with a breezeway or mud room. Mr. Kremzar asked if she would consider putting it 5 ft. back which <br />would be in coinpliance with the code. She replied it would make the future breezeway or patio area <br />too big. Mr. Kremzar said it looks like it is against the patio right now. Miss Ink indicated she does <br />not have a patio now. Mr. Konold asked if she really needs this variance for future work to be done. <br />Miss Ink replied she just needs the one variance. Mr. Maloney said if she went back 5 ft. she could <br />still build a breezeway and tie it to a patio. She wouldn't need a variance. He added that in this <br />situation she would need a firewall. Miss Ink indicated she is aware of the firewall requirement. She <br />said the breezeway is to connect from the back door, which is the center of the back of the house to the <br />man door that will be on the enlarged garage. This is for the future. She is not building a breezeway <br />right now. The first thing she wants to do is build a garage. Mr. Kremzar said if they deny the request <br />the applicant can still move it back and build a garage. Mr. William Formoso Jr. came forward to be <br />sworn in and address the board. He received a legal notice on this matter. He said Miss Ink wants the <br />garage closer to the house which will make it better when she goes to put a roof or awning on it. Mr. <br />Kremzar pointed out if she added 5 ft. it wouldn't add to the height of the roof. Mr. Formoso said that <br />is if it's a gable roof. He doesn't think a gable roof would be possible. She is looking for a shed roof <br />that would come off of her house, or even a metal awning, that would be a shed type roof that would <br />lean down toward her garage. Miss Ink said if she makes the garage 16 ft. away by the time the shed
