CITY OF NORTH OLMSTED <br />"TOGETHER WE CAN MAKE A DIFFERENCE" <br />BOARD OF ZONING APPEALS MINiJTES <br />OCTOBER 3, 2002 <br />I. ROLL CALL: Vice Chairman Kremzar called the meeting to order at 7:30 p.m. <br />PRESENT: Chairman Maloney, and board members, W. Kremzar, Nancy Sergi, and J. Konold <br />ABSENT: T. Kelly <br />ALSO PRESENT: Assistant Law Director, B. 0'Malley, Assistant Building Commissioner <br />T. Rymarczyk, and Assistant Clerk of Commissions, A. Kilbane <br />II. REVIEW AND CORRECTION OF MINUTES: The Board of Zoning Appeals minutes of September 5, 2002 have <br />been submitted for review. <br />Vice Chairman Kremzar indicated he will facilitate the meeting at the request of Chairman Maloney. <br />J. Konold made a motion to approve the minutes as submitted. The motion was seconded by J. Maloney and <br />unanimously approved. <br />Vice Chairnlan Kremzar reviewed that there were 9 cases requesting 22 variances and no special permits. The Vice <br />Chairman advised that each board member had viewed the premises involved for each case. He pointed out one <br />board member is absent and three votes are required for approval. In addition, each case will be judged on the <br />physical situation peculiar to itself, so that in no way is a judgment rendered considered to be a general policy <br />judgment affecting properties and like situations elsewhere. <br />III. BUILDING DEPARTMENT REQiTESTS: <br />1) Dave & Beth Goebels; 28490 Willet Road: VVRD -1 <br />Request for variance (1123.12). The proposal consists of an addition. <br />The following variance is requested: <br />1. A 16 foot variance for rear yard setback, residence too close to rear property line (code requires 50' applicant <br />shows 34'). <br />Which is in violation of Ord. 90-125 section (1135.08 (a)). <br />Vice Chairman Kremzar called all interested parties forward to review the request. Mr. Goebels and the contractor, <br />Mr. Sperli, came forward to be sworn in. Mr. Sperli indicated they want to put an addition on the back of the <br />house. A friend of the Goebels' has a similar room and they like the way it is situated. They want a little more <br />room and a little more light. Mrs. Sergi asked for clarification on why they want the addition. Mr. Goebels said <br />they will use it as another family room. A friend of his had one put on and they like it. He is certain Mr. Sperli <br />will do as good a job if not better than what their friends have. Mrs. Sergi asked if any neighbors have concerns. <br />Mr. Goebels indicated he had not heard from either neighbor. Mr. Kremzar asked if Mr. Rymarczyk had any <br />questions or comments. Mr. Rymarczyk indicated he did not. <br />J. Konold made a motion to grant Dave & Beth Goebels, 28490 Willet Road, their request for variance (1123.12), <br />which consists of an addition and that the following variance be granted: <br />1. A 16 foot variance for rear yard setback, residence too close to rear property line (code requires 50' applicant <br />shows 34'). <br />Which is in violation of Ord. 90-125 section (1135.08 (a)). The motion was seconded by W. Kremzar. Roll call <br />on the motion: W. Kremzar, yes, J. Konold, yes, J. Maloney, yes; and N. Sergi, abstain. Variance Granted. <br />2) Horst & Edith Hebrank26148 Kennedv Ridge Rd.:WRD - 4 <br />Request for variance (1123.12). The proposal consists of adding a sunroom. <br />1. A 2.9 foot front yard setback variance for addition within the required setback (code requires 50 ft., applicant <br />shows 47.1 ft.). <br />Which is in violation of Ord. 90-125 section (1135.06 (a)). <br />Vice Chairman Kremzar called all interested parties forward to review the request. Mr. and Mrs. Hebrank and their <br />representative, Phillip Sutman, came forward to be sworn in. Mr. Hebrank said they need inore room and they <br />would like more light. The house is much darker than they ever envisioned it, especially in the winter months. <br />The main reason they need the room is for the additional light.
