ROLL CALL: <br />Chairman Maloney called the meeting to order at 7:35 p.m. <br />PRESENT: Chairman J. Maloney, Board Members; W. Kremzar, N. Sergi, and J. Konold. <br />ALSO PRESENT: Law Director J. Dubelko, Assistant Building Commissioner T. Rymarczyk, and <br />Clerk of Commissions D. Rote. <br />ABSENT: Board Member; T. Kelly <br />II, REVIEW AND CORRECTION OF NIlNUTES: <br />The Board of Zoning Appeals minutes dated 7uly 9, 2003 are submitted for approval. <br />J. `]Konolcl motion to approve the July 9, 2003 Board of Zoning Appea9s irainutes as vvritten. <br />W. Kremzar seconded.the nnotaon, roll call on the motion W. YCremzar, J. Konold and J. Maloney <br />"Yes" N. Sergi abstain. Minutes Approved <br />Chairman Maloney indicated there were 6 cases requesting 13 variances and 1 special permit. The <br />Chairman advised that the board members have viewed the premises involved for each case. Three <br />votes are required for approval. In addition each case will be judged on the physical _ situation peculiar <br />to itself, so that in no way is a judgment rendered considered to be a general policy judgment affecting <br />properties and like situations elsewhere. <br />III. BUILDING DEPARTMENT REQUESTS: <br />l. Geor2e & Katherine Bgkaetekvq 23325 Stnaroce IDrive, WRD B: <br />Request for variance (1123.12). The proposal consists of a shed. <br />The following variance is requested: <br />1. A 36 square foot variance for storage building exceeding 2% rear yard area (code permits 60 sq. <br />ft., applicant shows 96 sq. ft.) <br />Which is in violation of Ord. 90-125 section (1135.02 (d) (1)). <br />Chairman Maloney called all interested parties forward to review their request. Mr. Bikichky the owner <br />caine forward to be sworn in and address the request. Mr. B'akichlsy indicated that he would like to <br />have the shed to accommodate his garden tools. A letter from Mr. Bikichky's neighbor was reviewed <br />and his neighbor would like the shed placed as close to the rear property line and sideline as possible <br />and any variances required be granted. Mr. Rymarczyk sugaested that there may be an electrical <br />easement along the rear property line. The applicant submitted his plans to have 10 foot off property <br />line. Lengthy discussion took place as to whether or not there was an easement on the rear of the yard. <br />Mr. lZyrriarczyk suggested tabling the request if the applicant wants to move the shed. li'Ir. Bikiclalcy <br />did not whish to be tabled. The board voiced that they would address the request as it was submitted. <br />W. Kreanzar motion to approve George & Katherine Bikichky of 23325 Sharon Dpive their request <br />for variance (1123.12) which consists of a shed and that the follovveng variance as grantecl: <br />A 36 square foot variance for storage builclang egceeding 2% rear yard area (code perrnits 60 sq. ft., <br />applicant shows 96 sq. ft.). Which is in violatiom o#' Ord. 90-125 section (1135.02 (d) (1)). J. Konold <br />seconded the tnotion, which was unanirnously approved. Variance Granted
