r„ <br />CITY OF NORTH OLMSTED <br />"TOGETHER WE CAN MAKE A DIFFERENCE" <br />BOARD OF ZONING APPEALS <br />MINUTES - JUNE 5, 2003 <br />7:30 P.M. <br />I. ROLL CALL: <br />Chairman Maloney called the meeting to order at 7:35 p.m. <br />PRESENT: Chairman J. Maloney, Board members N. Sergi, J. Konold, W. Kremzar, and T. Kelly <br />ALSO PRESENT: Assistant Law Director B. O'Malley, Building Commissioner D. Conway, and Clerk <br />of Commissions D. Rote. <br />II. REVIEEW AND CORRECTION OF NIINUTES: <br />The Board of Zoning Appeals minutes of May 1, 2003 were submitted for approval. <br />J. Konold motioned to approve the Board of Zoning Appeals minutes dated May 1, 2003 as <br />submitted. W. Kremzar seconded the motion, which was unanimously approved. <br />Chairman Maloney indicated there were 16 cases requesting 24 variances. The Chairman advised that <br />the board members have viewed the premises involved for each case. Three votes are required for <br />approval. In addition each case will be judged on the physical situation peculiar to itself, so that in no <br />way is a judgment rendered considered to be a general policy judgment affecting properties and like <br />situations elsewhere. <br />III. BUILDING DEPARTMENT REQUESTS: <br />1). Tim & Laura Rankin, 25020 Rainbow Drive, WRD 4 <br />Request for variance (1123.12). The proposal consists of a permanent lot split of PP# 237-30-016 <br />with lot frontage less than required. <br />The following variance is requested: <br />1. A special variance for the frontage requirement of 80 feet, (code requires 80', applicant shows <br />76.17'). Which is in violation of Ord. 90-125 section (1135.05 (a)(1)). Note: This request was <br />tabled by the Board of Zoning Appeals 05/01/03. <br />Chairman Maloney called all interested parties forward to review their request. No representative <br />came forward to present the request for the second month. Discussion took place regarding no <br />representative being present for the second time. <br />J. Maloney motioned to deny the application of Time & Laura Rankin of 25020 Rainbow Drive <br />in view of being absent for two meetings. J. Konold seconded the motion, roll call on the <br />motion; N. Sergi "No", J. Maloney, W. Kremzar, T. Kelly and J. Konold "Yes" motion carried. <br />Variance denied. <br />2). JacQUeline Miller, 3161 W. 231, WRD 2 <br />Request for variance (1123.12). The proposal consists of an addition. <br />The following variance is requested: <br />1. A 12 foot variance for rear yard setback (new 12'x30' addition), (code requires 50', applicant <br />shows 38'). Which is in violation of Ord. 90-125 section (1135.08 (a)). Note: This request was <br />tabled by the Board of Zoning Appeals 05/01/03. <br />Chairman Maloney called all interested parties forward to review their request. Mrs. Miller the owner <br />came forward to be sworn in and address her request. The applicant reviewed that she would like to
